Proposed amendment

Tamatha Paul, in Committee, to move the following amendment:

New clause 24AA

After clause 24 (page 7, after line 33), insert:

24AA New section 96B inserted

After section 96A, insert:

96B Imposition of conditions on release of offender sentenced to imprisonment for offence against section 216Q of Crimes Act 1961

(1)

If a court sentences an offender to a term of imprisonment for an offence against section 216Q of the Crimes Act 1961, the court must at the same time impose a special condition on the offender requiring the offender to participate in a programme (as defined in section 16 of the Parole Act 2002) to reduce the risk of further offending by the offender through the rehabilitation and reintegration of the offender.

(2)

The court may specify that a condition imposed under this section expires on—

(a)

the sentence expiry date; or

(b)

the date that is a specified period before the sentence expiry date; or

(c)

the date that is a specified period of up to 6 months after the sentence expiry date.

(3)

In this section, sentence expiry date and special conditions have the meanings given in section 4(1) of the Parole Act 2002.

Explanatory note

This Amendment Paper amends the Crimes Legislation (Stalking and Harassment) Amendment Bill. This amendment ensures that offenders who fall outside of the Family Court process (where there is no family or domestic relationship between victim and offender) are offered offence-based rehabilitation programmes within the general justice system. This affirms that all offenders have the right to access rehabilitation and reintegration support services.
