New clause 118B
After clause 118 (page 51, after line 18), insert:
Restriction on donations to party and candidates
118B New sections 207AA and 207AB inserted
After section 207A, insert:
207AA Restriction on donations to party and candidates
(1)
This section applies to any donor who makes donations to—
(a)
a party; and
(b)
individual candidates from the party in paragraph (a).
(2)
Any donor to whom this section applies is limited, in each electoral cycle, to making total donations of no more than $30,000 in aggregate across any specific party and candidates from that party.
(3)
In this section, electoral cycle means the period that—
(a)
starts on the day after the polling day of a general election; and
(b)
ends on the polling day of the general election following.
207AB Offence relating to contravention of section 207AA
A person who fails, without reasonable excuse, to comply with section 207AA commits an offence and is liable on conviction to a fine not exceeding $40,000.
Explanatory note
This Amendment Paper amends the Electoral Amendment Bill to cap donations from a donor to $30,000 across a party and its candidates in each three-year electoral cycle.
This was a recommendation of the Independent Electoral Review in order to reduce undue access and influence in our electoral system acquired through large donations.
This is important for protecting the integrity of the electoral system.
