Proposed amendment
Ricardo Menéndez March, in Committee, to move the following amendment:
Clause 5
In clause 5, after new section 198A(4) (page 4, after line 6), insert:
(4A)
Before revising a person’s entitlement or establishing, recovering, or increasing any overpayment or debt due to retrospective application of section 198 or 198A, MSD must—
(a)
assess whether such action would cause substantial financial hardship or lead to inequitable outcomes for the person or their household; and
(b)
take all reasonable steps to avoid or mitigate hardship and ensure equity, including the power to waive, reduce, or defer recovery.
Explanatory note
This Amendment Paper amends the Social Security (Accident Compensation and Calculation of Weekly Income) Amendment Bill.
