Proposed amendment
Cameron Luxton, in Committee, to move the following amendment:
New clause 10A
After clause 10 (page 12, after line 32), insert:
10A New section 72A inserted (Restriction on betting profits from overseas greyhound racing)
After section 72, insert:
72A Restriction on betting profits from overseas greyhound racing
(1)
This section applies to TAB NZ’s betting profits from overseas greyhound racing.
(2)
Any profit for which this section applies must be only used for—
(a)
an animal welfare related purpose; or
(b)
an approved greyhound rehoming programme; or
(c)
an approved compensation scheme.
(3)
The Minister must, every 12 months after the date on which the amendment Act comes into force, approve any organisation, programme, scheme, or initiative before any profit for which this section applies is used under subsection (2).
(4)
For the avoidance of doubt, any profit for which this section applies must not be used for—
(a)
the benefit of the other racing codes; or
(b)
any purpose that directly or indirectly supports the conduct, operation, or promotion of galloping or harness racing.
(5)
Despite subsection (4), the Minister may direct TAB NZ to use betting profits from overseas greyhound racing for any purpose that the Minister thinks fit.
(6)
As soon as practicable after giving a direction under subsection (5), the Minister must publish it in the Gazette.

In this section,—
amendment Act means the Racing Industry (Closure of Greyhound Racing Industry) Amendment Act 2025
approved compensation scheme means any compensation scheme that is required under this Act that relates to the closure of the greyhound racing industry
approved greyhound rehoming programme means a programme approved by the Minister under subsection (2) that supports the rehoming of specified greyhounds
betting profits has the same meaning as in section 73(3).

This section applies despite anything to the contrary in this Act or any other enactment.
Explanatory note
This Amendment Paper amends the Racing Industry (Closure of Greyhound Racing Industry) Amendment Bill to insert new section 72A into the principal Act to ensure that profits earned by TAB NZ from betting on overseas greyhound races cannot be redistributed to other racing codes, including horse and harness racing. It requires those profits to be accounted for separately and used only for animal welfare related purposes or as otherwise directed by the Minister.
