Proposed amendment
Cameron Luxton, in Committee, to move the following amendment:
Schedule 1
In Schedule 1, New Part 3 of Schedule 1, after clause 34 (page 19, after line 25), insert:
35 Review of amendments made by amendment Act
(1)
The Minister must arrange for an independent review of this Act as amended by the amendment Act for the purposes outlined in subsection (2).
(2)
The purpose of the review is to—
(a)
assess the extent of the financial loss to any affected person that has resulted from the commencement of the amendment Act; and
(b)
recommend the establishment of a compensation scheme that seeks to address the financial loss to those affected persons.
(3)
A recommendation under subsection (2)(b) must include, without limitation,—
(a)
any eligibility requirements for the scheme; and
(b)
a proposed funding arrangement for the scheme that will be provided by TAB NZ.
(4)
The Minister must appoint an independent reviewer to carry out the review.
(5)
In considering the appointment of the independent reviewer, the Minister must consult with, and have regard to, the views of GRNZ before its dissolution.
(6)
The review must begin as soon as practicable after the commencement of this clause.
(7)
The recommendation of the review must be reported to the Minister.
(8)
The Minister must present a copy of the report on the review to the House of Representatives as soon as practicable after receiving the report.
(9)
In this clause,—
affected person means any recognised industry organisation in relation to greyhound races or any person that the independent reviewer considers fit
financial loss includes harm to a person’s capital investments or commercial ventures
GRNZ has the meaning given in section 53A(4).
Explanatory note
This Amendment Paper amends the Racing Industry (Closure of Greyhound Racing Industry) Amendment Bill to insert new clause 35 into Schedule 1 of the principal Act. This amendment provides that once the Bill becomes law, the Minister must commission an independent review to design a compensation mechanism for those economically impacted by the banning of greyhound racing in New Zealand, and how it will be funded by TAB NZ. It requires the Minister to consult with, and have regard to the views of, Greyhound Racing New Zealand in appointing the person to conduct the independent review.
