Proposed amendment
Dr Lawrence Xu-Nan, in Committee, to move the following amendment:
Clause 11A
Replace clause 11A(1) (page 12, lines 21 to 22):
(1)
Replace section 127(1) with:
(1)
A board’s paramount objectives in governing a school are to:
(a)
ensure that every student at the school is able to attain their highest possible standard in educational achievement:
(b)
give effect to Te Tiriti o Waitangi:
(c)
give effect to relevant student rights set out in this Act, the New Zealand Bill of Rights Act 1990, and the Human Rights Act 1993:
(1A)
Delete section 127(2)(c)(ii).
Explanatory note
This Amendment Paper amends the Education and Training (System Reform) Amendment Bill. With over 70 percent of schools reconfirming their obligations under Te Tiriti o Waitangi, and the urgent hearing at the Waitangi Tribunal (WAI 3553), it is vital that this clause is added back to the Education and Training Act 2020 as a paramount objective, as well as student rights under the New Zealand Bill of Rights Act 1990 and the Human Rights Act 1993.
