(1)
A person must not light or allow another person to light a fire in open air in an area that is in a prohibited fire season.
(2)
Subsection (1) does not apply to a person who lights or allows another person to light a fire in accordance with—
a permit granted under regulations made under section 151; and
any conditions of the permit.
(3)
A person commits an offence if the person knowingly or recklessly contravenes subsection (1).
(4)
A person who commits an offence under this section is liable on conviction,—
in the case of an individual, to a term of imprisonment not exceeding 2 years or to a fine not exceeding $300,000, or both:
in any other case, to a fine not exceeding $600,000.
