Confidentiality

266 Disclosure of information or data by Bank to other persons

(1)

This section applies to the following:

(a)

information or data provided to the Bank under this subpart:

(b)

information or data derived from or based on information referred to in paragraph (a).

(2)

The Bank may publish or disclose any information or data to which this section applies only if—

(a)

the information or data is available to the public under an Act or is otherwise publicly available information; or

(b)

the information or data is in a statistical or summary form; or

(c)

the disclosure is for the purposes of, or in connection with, the performance or exercise of any function or power conferred or imposed on the Bank by this Act or any other legislation; or

(d)

the disclosure is made under subpart 3 (which relates to information sharing); or

(e)

the disclosure is to a person who the Bank is satisfied has a proper interest in receiving the information or data; or

(f)

the disclosure is with the consent of the person who supplied the information or data or to whom the information or data relates.

(3)

The Bank may not disclose information under subsection (2)(e) unless satisfied that satisfactory provision exists to protect the confidentiality of the information.

(4)

A member, the Governor, any other office holder of the Bank, or any employee of the Bank must not publish or disclose any information or data to which this section applies except for the purposes of, or in connection with, the performance or exercise of any function, power, or duty under this Act or any other legislation.

(5)

Nothing in any legislation, other than this Act or the Official Information Act 1982, requires the Bank or any person to whom information or data has been published or disclosed under this section to make that information or data available to any other person.
