199 Powers of Minister to prohibit disclosure of information, documents, and evidence

(1)

The Minister may, in relation to any application for authorisation, make an order prohibiting—

(a)

the publication or communication of all or any information, document, and evidence which is given to, or obtained by, the Ministry under this subpart:

(b)

the giving of any evidence involving any information, document, or evidence referred to in paragraph (a).

(2)

An order may be expressed to have effect for the period specified in the order.

(3)

However, no order has effect,—

(a)

if the order was made in connection with any application for authorisation, after the expiry of 20 working days from the date on which the Minister makes a final determination in respect of that application; or

(b)

if the application is withdrawn before the Minister makes a final determination, after the date on which the application is withdrawn.

(4)

On the expiry of an order, the Official Information Act 1982 applies in respect of any information, document, or evidence that was the subject of that order.

(5)

A person who, contrary to an order, publishes or communicates any information, document, or evidence that was the subject of that order commits an offence and is liable on conviction,—

(a)

in the case of an individual, to a fine not exceeding $7,500:

(b)

in the case of any other person, to a fine not exceeding $25,000.
