Explanatory note
General policy statement
This Bill amends the Racing Industry Act 2020 to prohibit the destruction (by any means) of greyhounds that are registered with New Zealand Greyhound Racing Association Incorporated (GRNZ) unless it is done by a veterinarian for a reason specified in the greyhound euthanasia policy of GRNZ or by a person acting under the authority of any other legislation.
The Government has agreed in principle to close the greyhound racing industry from 1 August 2026. While most people in the industry will act in good faith in keeping or rehoming their greyhounds during the closure period, there is a concern that a small number of owners may take steps to dispose of their greyhounds only because they have become less economically valuable and, with closure imminent, GRNZ’s current euthanasia policy will no longer be an effective deterrent to the unnecessary destruction of greyhounds.
This Bill gives effect to the Government’s intent by applying the GRNZ greyhound euthanasia policy that is in place at the time of enactment to greyhounds regardless of whether their owners choose to exit the industry. Under GRNZ’s greyhound euthanasia policy a dog may not be destroyed for economic reasons. Under this policy, a main reason a greyhound may be euthanised is that a veterinarian has certified that the greyhound is suffering from a condition or injury that causes significant pain or discomfort or a marked reduction in quality of life, such that it is inhumane or would otherwise compromise the welfare of the greyhound to delay euthanasia.
This Bill creates a new offence of intentionally destroying a greyhound that is or was registered with GRNZ or the offspring of a breeding female that is registered with GRNZ. A person who commits the offence will be liable to a term of imprisonment not exceeding 12 months or a fine not exceeding $50,000, or both. This is based on penalties for similar offences found in the Animal Welfare Act 1999 (such as failing to ensure the physical, health, and behavioural needs of an animal are met or killing an animal in a manner that it suffers unreasonable or unnecessary pain or distress).

Clause by clause analysis
Clause 1 is the Title clause.
Clause 2 is the commencement clause. It provides that the Bill comes into force on the day after Royal assent.
Clause 3 provides that the Bill amends the Racing Industry Act 2020 (the principal Act).
Clause 4 inserts new subpart 5 (new section 53A) into Part 2 of the principal Act, which creates a new offence relating to the unlawful destruction of specified greyhounds.
New section 53A(1) provides that a person (other than a veterinarian or a veterinary student acting under the direct supervision of a veterinarian) commits an offence if the person—
intentionally destroys a specified greyhound; or
knowingly participates in, or procures, the destruction of a specified greyhound.
New section 53A(2) excludes the following from the offence:
the euthanasia of a specified greyhound procured by any person that is undertaken by a veterinarian for a reason specified in clause 2 or 3 of the greyhound euthanasia policy of GRNZ that was in force immediately before the commencement of new section 53A:
the destruction of a specified greyhound by a person acting under the authority of any other legislation.
New section 53(3) provides that a person who commits the offence is liable on conviction to a term of imprisonment not exceeding 12 months or a fine not exceeding $50,000, or both.
New section 53A(4) defines terms used in new section 53A, including the terms specified greyhound and destroy. It provides that a specified greyhound means a greyhound that is or was registered with GRNZ before, on, or after the commencement of new section 53A and includes the offspring of a breeding female, whether born before, on, or after the commencement of new section 53A. Destroy is defined as to destroy by any means.

Contents
The Parliament of New Zealand enacts as follows:
1 Title
This Act is the Racing Industry (Unlawful Destruction of Specified Greyhounds) Amendment Act 2024.
2 Commencement
This Act comes into force on the day after Royal assent.
3 Principal Act
This Act amends the Racing Industry Act 2020.
4 New subpart 5 of Part 2 inserted
After section 53, insert:
Subpart 5—Offence relating to greyhounds
53A Offence relating to unlawful destruction of specified greyhound
(1)
A person (other than a veterinarian or a veterinary student acting under the direct supervision of a veterinarian) commits an offence if the person—
(a)
intentionally destroys a specified greyhound; or
(b)
knowingly participates in, or procures, the destruction of a specified greyhound.
(2)
Subsection (1) does not apply to—
(a)
the euthanasia of a specified greyhound procured by any person that is undertaken by a veterinarian for a reason specified in clause 2 or 3 of the greyhound euthanasia policy of GRNZ that was in force immediately before commencement of this section:
(b)
the destruction of a specified greyhound by a person acting under the authority of any other legislation.
(3)
A person who commits an offence against this section is liable on conviction to a term of imprisonment not exceeding 12 months or a fine not exceeding $50,000, or both.
(4)
In this section,—
breeding female means a female greyhound that is registered with GRNZ for breeding purposes
destroy, in relation to a specified greyhound, means to destroy by any means
GRNZ means New Zealand Greyhound Racing Association Incorporated
specified greyhound—
(a)
means a greyhound that is or was registered with GRNZ in accordance with racing rules made under section 37 before, on, or after the commencement of this section; and
(b)
includes the offspring of a breeding female, whether born before, on, or after the commencement of this section
veterinarian has the meaning given by section 4 of the Veterinarians Act 2005.
