Pursuant to section 6 of the Wildlife Act 1953, the Minister of Internal Affairs hereby gives the following notice.

Notice

1
  • (1) This notice may be cited as the Little Shag Notice 1955.

    (2) This notice shall come into force on the date of its notification in the Gazette.

  • This notice shall be in force only within the Auckland, Tauranga, and Rotorua Acclimatization Districts.

  • In this notice the term little shag means any bird of the species Phalacrocorax brevirostris, also known as the white-throated shag or the little pied-shag.

  • Any person duly authorized in writing in that behalf by the Secretary of the Auckland Acclimatization Society or of the Tauranga Acclimatization Society or by the Director-General of Conservation may hunt or kill little shag on the waters containing trout in the Auckland or Tauranga or Rotorua Acclimatization District, as the case may be, specified in the authority, and may be in possession of little shags taken under that authority.

    Clause 4: amended, on 1 April 1987, by section 65(3) of the Conservation Act 1987 (1987 No 65).

  • No authority shall be issued under clause 4 of this notice, unless the person issuing the same considers it necessary for the adequate conservation of trout stocks in the waters specified therein that little shags be hunted or killed on those waters.

  • No person shall offer or accept any bounty or reward in respect of any bird hunted or killed under any authority issued under this notice.

  • Every authority issued under this notice shall be subject to the following conditions:

    • (a) it shall continue in force for the period specified therein not exceeding three months:

    • (b) the holder shall within one month after its expiration furnish in writing to the person who issued the authority a return showing the number of little shags taken by him:

    • (c) the holder shall, when so directed by the Director-General of Conservation, make available to the Director-General for the purpose of study or research any little shag taken by him.

    Clause 7(c): amended, on 1 April 1987, by section 65(3) of the Conservation Act 1987 (1987 No 65).

  • Nothing in any authority issued under this notice shall authorize the holder to hunt or kill or have in possession any little shag on any wildlife sanctuary or wildlife refuge or on any domain or reserve within the meaning of the Reserves and Domains Act 1953.

Explanatory note

[This note is not part of the notice, but is intended to indicate its general effect.]

This notice provides for the issue by the Acclimatization Society or by the Secretary for Internal Affairs of authorities for the taking of little shags on certain trout waters in the Auckland, Tauranga, and Rotorua Acclimatization Districts where the taking of little shags is considered necessary for the adequate conservation of trout stocks in those waters, and sets out the conditions on which those authorities may be issued.
