Wildlife Order 1970


Note

This order is administered in the Department of Internal Affairs.


PURSUANT to the Wildlife Act 1953, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

1 Title and commencement
  • (1) This order may be cited as the Wildlife Order 1970.

    (2) This order shall come into force on the seventh day after the date of its notification in the Gazette.

2 Application
  • This order shall have effect throughout New Zealand.

3 Absolutely protected wildlife
  • It is hereby declared that the bush hawk (Falco novae-seelendiae) shall cease to be included in Schedule 2 to the Wildlife Act 1953, and that Schedule shall hereafter be read accordingly.

4 Partially protected wildlife
  • It is hereby declared that the kea (Nestor notabilis) and the little owl (Athene noctua) shall cease to be included in Schedule 5 to the Wildlife Act 1953 and shall be included in Schedule 2 to that Act, and those Schedules shall hereafter be read accordingly.

5 Unprotected wildlife
  • It is hereby declared that the black-backed gull (Larus dominicanus) shall cease to be included in Schedule 2 to the Wildlife Act 1953 and shall be included in Schedule 5 to that Act, and those Schedules shall hereafter be read accordingly.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

The effect of this order will be:

  • (a) The bush hawk is removed from Schedule 2 to the Wildlife Act 1953 and is not included in any other Schedule. It is accordingly fully protected throughout New Zealand:

  • (b) The kea and the little owl are transferred from Schedule 5 to that Act (wildlife not protected) to Schedule 2 (partially protected wildlife):

  • (c) The black-backed gull is transferred from Schedule 2 to Schedule 5, and will therefore be unprotected.
