These regulations are administered by the Department of Internal Affairs.

Pursuant to section 40 of the Passports Act 1992, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following regulations.

Regulations

1 Title and commencement

(1)

These regulations may be cited as the Passport (Fees) Regulations 1996.

(2)

These regulations shall come into force on 1 July 1996.

2 Interpretation

In these regulations, unless the context otherwise requires,—

the Act means the Passports Act 1992

passport means a New Zealand passport

passports office means an office that is responsible for issuing passports, certificates of identity, and refugee travel documents

Secretary means the Secretary for Internal Affairs.

Regulation 2 passports office: inserted, on 4 November 2005, by regulation 3 of the Passport (Fees) Amendment Regulations 2005 (SR 2005/287).

3 Fees

(1)

Subject to regulation 7A, the fees set out in Part 1 of the Schedule are payable for the matters set out in that Part, with different fees payable for—

(a)

an application lodged at a passports office in New Zealand or forwarded to a passports office in New Zealand from a New Zealand overseas mission or New Zealand overseas post; and

(b)

an application lodged at a passports office in London or Sydney or forwarded to a passports office in London or Sydney from a New Zealand overseas mission or New Zealand overseas post.

(2)

Subject to regulation 7A, the fees set out in Part 2 of the Schedule are payable for the matters set out in that Part, being services provided by a New Zealand overseas mission or New Zealand overseas post (not being a passports office in London or Sydney).

4 Priority service fee

(1)

Subject to regulations 7 and 7A, the priority service fee specified in item 6 of Part 1 of the Schedule shall be payable in respect of any application for the urgent issue of any passport or the urgent issue of a certificate of identity, being an application that is required to be processed within a time frame that requires that application to be given priority over other applications of the same type.

(2)

The priority service fee may be payable either at the time at which the application is made or subsequently.

5 Callout fee

Subject to regulations 7 and 7A, the callout fee specified in item 7 of Part 1 of the Schedule shall be payable in respect of any application for the urgent issue of any passport or the urgent issue of a certificate of identity, being an application that is required to be processed within a time frame that requires the attendance of officers outside of ordinary working hours.

6 Callout and priority service fees to be additional fees

(1)

Where a priority service fee is payable under regulation 4 or a callout fee is payable under regulation 5 in respect of an application, that fee shall be payable in addition to whatever other fee is payable in respect of that application.

(2)

Both a priority service fee and a callout fee shall not be payable in respect of the same application.

7 Exemption in respect of urgent travel for death or serious illness

If the Secretary is satisfied that the time at which an application is made is dictated by the applicant’s urgent need to travel and that that urgent need to travel arises because of a situation involving—

(a)

the death or serious illness of—

(i)

a member of the applicant’s family; or

(ii)

a friend or business associate of the applicant; or

(b)

the serious illness of the applicant,—

then—

(c)

notwithstanding regulations 4 and 5, neither a priority service fee nor a callout fee shall be payable in respect of the application.

7A Certain fees not payable for urgent need to travel because of exceptional circumstances

(1)

This regulation applies to an applicant who is outside New Zealand at the time the relevant application is made.

(2)

A fee specified in subclause (3) is not payable in respect of an application for the urgent issue of a passport, or the issue of an emergency travel document, if the Secretary is satisfied that the timing of the application is dictated by the applicant’s urgent need to travel because of exceptional circumstances that—

(a)

require or may require the applicant to urgently leave the country in which he or she is present; and

(b)

prevent the applicant from retrieving his or her valid passport (if one exists) because of the urgency of the situation or potential threat to the applicant’s safety (or both).

(3)

The fees are—

(a)

the priority service fee payable under regulation 4:

(b)

the callout fee payable under regulation 5:

(c)

the fee specified in item 2 of Part 2 of the Schedule payable under regulation 3.

(4)

For the purposes of this regulation, exceptional circumstances means—

(a)

an invasion, coup d’état, violent uprising, terrorist act, or war affecting the country in which the applicant is present; or

(b)

a natural disaster or serious outbreak of disease affecting the country in which the applicant is present; or

(c)

the applicant having been the victim of kidnapping or human trafficking while in the country in which he or she is present; or

(d)

any circumstances of a similar nature to those specified in paragraphs (a) to (c).

7B Online fees

The fees set out in Part 3 of the Schedule are payable for applications lodged online through an Internet site maintained by or on behalf of the Secretary.

8 Payment of fees

Except as provided in regulation 4(2), all fees prescribed by these regulations shall be payable on the making of the relevant application and shall not be refundable if the application is declined.

9 Goods and services tax

The fees prescribed by these regulations are expressed exclusive of any goods and services tax payable under the Goods and Services Tax Act 1985.

10 Revocation

The Passport (Fees) Regulations 1993 (SR 1993/134) are hereby consequentially revoked.
