These regulations are administered in the Department for Courts.


Pursuant to section 212(2)(b) of the Summary Proceedings Act 1957, and section 410(2)(b) of the Crimes Act 1961, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, makes the following regulations.

Regulations

1 Title and commencement
  • (1) These regulations may be cited as the Criminal Proceedings (Search Fees) Regulations 1997.

    (2) These regulations come into force on 1 January 1998.

2 Application
  • These regulations apply to criminal proceedings in the High Court (including proceedings on appeal), and criminal proceedings in the Court of Appeal and criminal proceedings in the Supreme Court.

    Regulation 2: amended, on 1 April 2004, by regulation 3 of the Criminal Proceedings (Search Fees) Amendment Regulations 2004 (SR 2004/29).

3 Fees
  • (1) Subject to subclauses (2) and (3), the fees specified in the Schedule are payable, and must be taken by the proper officer of the High Court or (as the case may require) the Court of Appeal or the Supreme Court, in relation to proceedings to which these regulations apply in respect of the matters so specified.

    (2) The fees prescribed by subclause (1) are not payable by any party to the proceedings or a solicitor acting for a party.

    (3) Where it appears to the satisfaction of the High Court or the Court of Appeal or the Supreme Court or a Judge that any person is unable, or ought not to be required, to pay a fee or part of a fee specified in the Schedule, the Court or Judge may dispense with payment of the whole or part of that fee, subject to such terms as the Court or Judge thinks fit.

    Regulation 3(1): amended, on 1 April 2004, by regulation 4 of the Criminal Proceedings (Search Fees) Amendment Regulations 2004 (SR 2004/29).

4 Goods and services tax included
  • The fees prescribed by these regulations are inclusive of goods and services tax.

5 Saving
  • Nothing in these regulations entitles any person to search, inspect, or copy a register, book, file, or document that the person would not, apart from these regulations, be entitled to search, inspect, or copy.

6 Revocation
  • The Criminal Proceedings (Search Fees) Regulations 1992 (SR 1992/140) are consequentially revoked.
