These regulations are administered by the Ministry of Social Development.

Pursuant to section 132F of the Social Security Act 1964, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, makes the following regulations.

Regulations

1 Title and commencement

(1)

These regulations may be cited as the Social Security (Participation Allowance) Regulations 1998.

(2)

These regulations come into force on 1 October 1998.

2 Interpretation

In these regulations, the Act means the Social Security Act 1964.

3 Participation allowance

(1)

The chief executive may pay any beneficiary a participation allowance in respect of the beneficiary’s participation under the Act in an activity of the kind described in the first column of the Schedule.

(2)

The relevant rates of participation allowance are set out in the second column of the Schedule.

4 Reimbursement portion of participation allowance

If a participation allowance includes a maximum amount for reimbursement of a beneficiary’s actual costs of participation in an activity, the chief executive must determine the amount to be paid to the beneficiary.

ActivityAmount of allowance
An activity in the community (as defined in the Act).
(a)

An amount calculated in accordance with the following formula:

($21 ÷ a) × b

where—

a

is the number of days in the week that the beneficiary had undertaken to attend at the activity; and

b

is the number of days in the week that the beneficiary actually attended at the activity:

Where the amount in paragraph (a) is insufficient to reimburse the beneficiary for the travel and other costs of participating in the activity, a further amount towards those costs up to a maximum of $20.
