Fisheries (Interim and Annual Deemed Values) Notice 2003 Amendment Notice (No 3) 2003: revoked, on 29 September 2015, pursuant to clause 9(1) of the Fisheries (Total Allowable Catch, Total Allowable Commercial Catch, and Deemed Value Rates) Notice 2015 (LI 2015/211).

Pursuant to section 75 of the Fisheries Act 1996, the Minister of Fisheries gives the following notice.

1 Title

(1)

This notice is the Fisheries (Interim and Annual Deemed Values) Notice 2003 Amendment Notice (No 3) 2003.

In this notice, the Fisheries (Interim and Annual Deemed Values) Notice 20031 is called “the principal notice”.

2 Commencement

This notice comes into force on the day after its notification in the Gazette.

3 New clause 3 substituted

The principal notice is amended by revoking clause 3, and substituting the following clause:

3 Application

This notice applies to fish taken on or after—

(a)

1 October 2003 for fish in respect of which the fishing year begins on 1 October 2003:

(b)

1 February 2004 for fish in respect of which the fishing year begins on 1 February 2004:

(c)

1 April 2004 for fish in respect of which the fishing year begins on 1 April 2004.

4 Revocation

Clause 8 of the principal notice is amended by revoking subclause (2), and substituting the following subclause:

Despite subclause (1), that notice continues to apply to fish taken—

(a)

on or after 1 October 2002 and before 1 October 2003 for fish in respect of which the fishing year began on 1 October 2002:

(b)

on or after 1 February 2003 and before 1 February 2004 for fish in respect of which the fishing year began on 1 February 2003:

(c)

on or after 1 April 2003 and before 1 April 2004 for fish in respect of which the fishing year began on 1 April 2003.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice, which comes into force on the day after the date of its notification in the Gazette, amends the Fisheries (Interim and Annual Deemed Values) Notice 2003 to correct the fishing year in respect of which the application clause and revocation clause apply. The notice applies to fish taken in the fishing year that began on 1 October 2003. However, the notice applies to some fishstock in respect of which the next fishing year begins on 1 February 2004 or 1 April 2004. The amendments recognise the different fishing years for fishstocks in respect of which the fishing year begins on those dates.
