Pursuant to section 154 of the Motor Vehicle Sales Act 2003, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council and on the recommendation of the Minister of Consumer Affairs, makes the following order.

1 Title

This order is the Motor Vehicle Sales (Abolition of Motor Vehicle Dealers Licensing Board) Order 2004.

2 Commencement

This order comes into force on 31 December 2004.

3 Board abolished

The Board is abolished.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 31 December 2004, abolishes the Motor Vehicle Dealers Licensing Board (the Board).

The Board was constituted under section 6A of the Motor Vehicle Dealers Act 1975 (the 1975 Act), which was repealed by the Motor Vehicle Sales Act 2003 (the 2003 Act). Despite the repeal of the 1975 Act, however, section 154 of the 2003 Act provides for the continuation of the Board until a date fixed by the Governor-General by Order in Council. Section 154(2) of the 2003 Act provides that the Governor-General may fix the date only if the Board has certified that—

  • the Board has completed its functions; and

  • all disciplinary proceedings before the Board have been completed; and

  • all appeals relating to those proceedings have been determined.

The Board has now certified as to those matters and, accordingly, this order provides for the abolition of the Board.
