Securities Act (Employer Superannuation Schemes) Exemption Amendment Notice 2006: revoked, on the close of 30 November 2016, pursuant to clause 3 of the Securities Act (Employer Superannuation Schemes) Exemption Notice 2004 (SR 2004/215).

Pursuant to the Securities Act 1978, the Securities Commission gives the following notice (to which is appended a statement of reasons of the Securities Commission).

1 Title

This notice is the Securities Act (Employer Superannuation Schemes) Exemption Amendment Notice 2006.

In this notice, the Securities Act (Employer Superannuation Schemes) Exemption Notice 2004 is called “the principal notice”.

2 Commencement

This notice comes into force on the day after the date of its notification in the Gazette.

3 Exemption from section 37(1) of Act for employer superannuation schemes

Clause 5(c) of the principal notice is amended by inserting, after the word “spouses,”, the words “civil union partners,”.

4 Exemption from section 37(1) of Act for small employer superannuation schemes

Clause 6(c) of the principal notice is amended by inserting, after the word “spouses,”, the words “civil union partners,”.

5 Condition relating to successors in business

Clause 10A(1)(b) of the principal notice is amended by inserting, after the word “spouse,” the words “civil union partner,”.

Statement of reasons

This notice, which comes into force on the day after the date of its notification in the Gazette, amends the Securities Act (Employer Superannuation Schemes) Exemption Notice 2004 by including references to civil union partners.

The Securities Commission considers that it is appropriate to make the amendments, so that the notice is updated following the enactment of the Civil Union Act 2004 and treats spouses and civil union partners on the same basis.
