  • Preamble

    At Wellington this 27th day of August 2007

Pursuant to section 303 of the Education Act 1989, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
  • These regulations are the Student Allowances Amendment Regulations (No 2) 2007.

2 Commencement
  • These regulations come into force on 1 September 2007.

3 Principal regulations amended
  • These regulations amend the Student Allowances Regulations 1998.

4 Application
  • These regulations apply in relation to the assessment and payment of allowances to students for weeks starting on or after 1 January 2008 (whether the allowance were first payable to the students before, on, or after that date).

5 Reassessment of parental income
  • (1) Regulation 5(1) is revoked and the following clause substituted:

    • (1) The chief executive may reassess the annual parental income of any student exceeding $44,333.64 if, in any year during that student's course of study, that income decreases by not less than 25%.

    (2) Regulation 5(2) is amended by omitting an amount or and substituting a.

6 Schedule 1 revoked
  • Schedule 1 is revoked.

7 Schedule 2 amended

    Regulation 7: revoked, on 1 April 2008, by regulation 5(b) of the Student Allowances Amendment Regulations 2008 (SR 2008/55).

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 September 2007, amend the Student Allowance Regulations 1998 (the principal regulations).

These regulations apply to the assessment and payment of student allowances for weeks starting on or after 1 January 2008.

Regulation 7 increases by 10% the level of weekly parental income used in calculating the basic grant payable to a single student who is childless and under 25. The basic grant is only reduced if the weekly parental income exceeds the higher threshold of $852.57 per week (increased from $775.06 per week).

As a result of this new threshold, the provision in regulation 5 of the principal regulations, for the reassessment of parental income, is only relevant where parental income exceeds $44,333.64 per annum and that income is decreased by at least 25%. Regulation 5 of the principal regulations is amended to make this clear and to remove the need to refer to Schedule 1 (which is consequentially revoked).
