Fisheries (Satellite Vessel Monitoring) Amendment Regulations 2007: revoked, on 1 October 2017, pursuant to regulation 12 of the Fisheries (Geospatial Position Reporting) Regulations 2017 (LI 2017/155).

Preamble

At Wellington this 15th day of October 2007

Pursuant to section 297 of the Fisheries Act 1996, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title

These regulations are the Fisheries (Satellite Vessel Monitoring) Amendment Regulations 2007.

2 Commencement

These regulations come into force on 15 November 2007.

3 Principal regulations amended
4 Interpretation

Regulation 2 is amended by inserting the following definition in its appropriate alphabetical order:

benthic protection area has the meaning given to it in regulation 4 of the Fisheries (Benthic Protection Areas) Regulations 2007

5 Vessels required to carry and operate automatic location communicators

Regulation 3(1) is amended by inserting the following paragraph after paragraph (ea):

(eb)

New Zealand fishing vessels of 28 metres or less in length that are used at any time during a fishing year to trawl within a benthic protection area; and

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 15 November 2007, amend the Fisheries (Satellite Vessel Monitoring) Regulations 1993 by—

  • inserting a definition of benthic protection area; and

  • inserting a new regulation 3(1)(eb), which requires an automatic location communicator to be carried and operated on board New Zealand fishing vessels that are—

    • 28 metres or less in length; and

    • used at any time during a fishing year to trawl within a benthic protection area.

The amendments are required as a result of the establishment of benthic protection areas under the Fisheries (Benthic Protection Areas) Regulations 2007.
