Fisheries (Interim and Annual Deemed Values) Notice (No 3) 2003 Amendment Notice 2009: revoked, on 29 September 2015, pursuant to clause 9(1) of the Fisheries (Total Allowable Catch, Total Allowable Commercial Catch, and Deemed Value Rates) Notice 2015 (LI 2015/211).

This notice is administered by the Ministry for Primary Industries.

Pursuant to section 75 of the Fisheries Act 1996, the Minister of Fisheries, after consultation in accordance with section 75A of the Act, gives the following notice.

Notice

1 Title

This notice is the Fisheries (Interim and Annual Deemed Values) Notice (No 3) 2003 Amendment Notice 2009.

2 Commencement

This notice comes into force on 31 March 2009.

3 Application

This notice applies on and from the fishing year commencing on 1 April 2009.

4 Principal notice amended

This notice amends the Fisheries (Interim and Annual Deemed Values) Notice (No 3) 2003.

5 Interpretation

Clause 4(2) is amended by omitting “clauses 5(2) and 6(2) and in the first column of the Schedule” and substituting “this notice”.

6 Interim deemed values

(1)

Clause 5(1) is amended by omitting “the Schedule” and substituting “Schedule 1”.

(2)

Clause 5(2) is revoked.

7 New clause 6 substituted

Clause 6 is revoked and the following clause substituted:

6 Annual deemed values

(1)

The annual deemed values to be demanded by the chief executive under section 76(2A) and (2B) of the Act for the stocks specified in the first column of Schedule 1 are the amounts per kilogram specified for those stocks in the third column of that schedule.

(2)

Subclause (1) is subject to subclause (3).

(3)

The annual deemed values to be demanded by the chief executive under section 76(2A) and (2B) of the Act for the stocks specified in the first column of Schedule 2 are the amounts per kilogram specified for those stocks in the third column of that schedule for the appropriate level of catch specified in the second column of that schedule.

8 Values exclusive of GST

Clause 7(2) is amended by omitting “Schedule” and substituting “schedules”.

9 New Schedules 1 and 2 substituted

The Schedule is revoked and the schedules set out in the Schedule of this notice are substituted.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice, which comes into force on 31 March 2009, amends the Fisheries (Interim and Annual Deemed Values) Notice (No 3) 2003.

The Schedule of the notice is revoked and replaced with 2 schedules.

For all frilled venus shell (surf clam) stocks (BYA1, BYA2, BYA3, BYA4, BYA5, BYA7, BYA8, and BYA9), a differential deemed value at the rate of $0.84 per kg for catch in excess of 200% of ACE is introduced. There is no change to the interim or annual values.

For all ringed dosinia (surf clam) stocks (DAN1, DAN2, DAN3, DAN4, DAN5, DAN7, DAN8, and DAN9), a differential deemed value at the rate of $0.84 per kg for catch in excess of 200% of ACE is introduced. There is no change to the interim or annual values.

For all silky dosinia (surf clam) stocks (DSU1, DSU2, DSU3, DSU4, DSU5, DSU7, DSU8, and DSU9), a differential deemed value at the rate of $0.84 per kg for catch in excess of 200% of ACE is introduced. There is no change to the interim or annual values.

For all horse mussel stocks (HOR1, HOR2, HOR3, HOR4, HOR5, HOR6, HOR7, HOR8, HOR9, and HOR10), the interim deemed value is increased to $0.06 per kg. The annual deemed value is increased to $0.12 per kg. A differential deemed value at the rate of $0.24 per kg for catch in excess of 200% of ACE is introduced.

For all trough shell (surf clam) stocks (MDI1, MDI2, MDI3, MDI4, MDI5, MDI7, MDI8, and MDI9), a differential deemed value at the rate of $3.12 per kg for catch in excess of 200% of ACE is introduced. There is no change to the interim or annual values.

For all large trough shell (surf clam) stocks (MMI1, MMI2, MMI3, MMI4, MMI5, MMI7, MMI8, and MMI9), the interim deemed value is increased to $0.96 per kg. A differential deemed value at the rate of $3.84 per kg for catch in excess of 200% of ACE is introduced. There is no change to the annual value.

For all deepwater tuatua (surf clam) stocks (PDO1, PDO2, PDO3, PDO4, PDO5, PDO7, PDO8, and PDO9), a differential deemed value at the rate of $2.88 per kg for catch in excess of 200% of ACE is introduced. There is no change to the interim or annual values.

For all triangle shell (surf clam) stocks (SAE1, SAE2, SAE3, SAE4, SAE5, SAE7, SAE8, and SAE9), a differential deemed value at the rate of $2.04 per kg for catch in excess of 200% of ACE is introduced. There is no change to the interim or annual values.

For sea cucumber stock SCC3, the interim deemed value is increased to $1.50 per kg. The annual deemed value is increased to $2.00 per kg. Differential deemed value rates of $2.40, $2.80, $3.20, $3.60, and $4.00 per kg, depending on the level of catch in excess of ACE, are introduced.

For all other sea cucumber stocks (SCC1A, SCC1B, SCC2A, SCC2B, SCC4, SCC5A, SCC5B, SCC6, SCC7A, SCC7B, SCC7D, SCC8, SCC9, and SCC10), the interim deemed value is increased to $20.00 per kg. The annual deemed value is increased to $40.00 per kg. Differential deemed value rates are increased to $48.00, $56.00, $64.00, $72.00, and $80.00 per kg, depending on the level of catch in excess of ACE.

All deemed value rates for crab stocks (CHC1, CHC2, CHC3, CHC4, CHC5, CHC6, CHC7, CHC8, CHC9, CHC10, GSC1, GSC3, GSC5, GSC6A, GSC6B, GSC10, KIC1, KIC2, KIC3, KIC4, KIC5, KIC6, KIC7, KIC8, KIC9, and KIC10) are moved into the schedules, but there is no change to any of the values.
