Pursuant to section 75 of the Fisheries Act 1996, the Minister of Fisheries, after having regard to the matters specified in that section and after consultation in accordance with section 75A of that Act, gives the following notice.

1 Title

This notice is the Fisheries (Interim and Annual Deemed Values) Notice 2003 Amendment Notice (No 2) 2009.

2 Commencement

This notice comes into force on 30 September 2009.

3 Application

This notice applies to fish taken on or after 1 October 2009.

4 Principal notice amended

Clause 6(a)(i) is amended by omitting—

7 Schedule 1 amended

Schedule 1 is amended by omitting the items that correspond to each item set out in Part 1 of Schedule 1 of this notice and substituting, in each case, the corresponding item set out in Part 1 of Schedule 1 of this notice.

Schedule 1 is amended by inserting the items set out in Part 2 of Schedule 1 of this notice in their appropriate alphanumerical order.

8 Schedule 1A amended

(1)

The item relating to BAR1, BAR4, BAR5, and BAR7 in Schedule 1A is amended by omitting “BAR7”.

Schedule 1A is amended by inserting the items relating to BCO3, BCO4, BNS2, ELE3, ELE5, JMA1, MOK1, SNA2, SPO2, and TAR2 set out in Part 1 of Schedule 2 of this notice in their appropriate alphanumerical order.

The item relating to BNS1, BNS2, BNS3, BNS7, BNS8, and BNS10 in Schedule 1A is amended by omitting “BNS2”.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice, which comes into force on 30 September 2009, amends the Fisheries (Interim and Annual Deemed Values) Notice 2003 (the principal notice). The amendments substitute new interim, annual, and differential deemed values for various fishstock as set out in the notice. The new deemed values apply on and from the fishing year commencing on 1 October 2009.

Clause 5 amends clause 6(a)(i) of the principal notice by—

  • omitting the references to anchovy, ghost shark, pilchards, ribaldo, rough skate, sea perch, smooth skate, and sprat. Stocks of these species become subject to standard differential deemed values as specified in the principal notice except as outlined:

  • recasting the reference to green lipped mussel to green-lipped mussel (except GLM9). All stocks of green-lipped mussels, except GLM9, continue to have no differential deemed values. GLM9 becomes subject to standard differential deemed values as specified in the principal notice.

Clause 5 also amends clause 6(a)(ii) of the principal notice by—

  • omitting ELE3 and ELE5, which become subject to non-standard differential deemed values set out in Schedule 1A of the principal notice (as amended by Schedule 2 of this notice):

  • inserting RIB 8 and RIB9. The effect of this is that these stocks continue to not be subject to differential deemed values:

  • inserting SPE1, SPE5, SPE6, SPE8, SPE9, and SPE10. The effect of this is that these stocks of sea perch continue to have no differential deemed values. Because of the omission of “sea perch” from clause 6(a)(i), SPE2, SPE3, SPE4, and SPE7 become subject to standard differential deemed values as specified in the principal notice:

  • inserting RSK8, which relates to rough skate. The effect of this is that RSK8 will continue to not be subject to differential deemed values. All other rough skate stocks will be subject to standard differential deemed values as specified in the principal notice:

  • inserting SSK8, which relates to smooth skate. The effect of this is that SSK8 will continue to not be subject to differential deemed values. All other smooth skate stocks will be subject to standard differential deemed values as specified in the principal notice:

  • omitting SCH2, which relates to school shark. SCH2 therefore becomes subject (along with all other school shark stocks) to standard differential deemed values as specified in the principal notice:

  • omitting STA1 and STA2, which relate to stargazer. These stocks therefore become subject (along with all other stargazer stocks) to standard differential deemed values as specified in the principal notice:

  • omitting WWA5B, which becomes subject to non-standard differential deemed values set out in Schedule 1A of the principal notice (as amended by clause 8(7) of this notice).

Clause 6 amends clause 7 of the principal notice to clarify that the non-standard differential deemed values set out in Schedule 1A do not apply to stocks landed in and received by a licensed fish receiver located in the Chatham Islands.

Schedule 1 inserts and substitutes new items in Schedule 1 of the principal notice, which specifies interim and annual deemed values for various fishstock.

Schedule 2 inserts and substitutes new items in Schedule 1A of the principal notice, which specifies differential deemed values for different levels of catch.

Schedule 3 substitutes a new item in Schedule 2 of the principal notice, which specifies Chatham Islands deemed values for certain fish.
