Pursuant to section 6 of the Canterbury Earthquake Response and Recovery Act 2010, His Excellency the Governor-General makes the following order acting—

(a)

on the advice and with the consent of the Executive Council; and

(b)

on the recommendation of the relevant Minister made in accordance with section 6(2) of that Act.

Order

1 Title

This order is the Canterbury Earthquake (Resource Management Act) Amendment Order 2010.

2 Commencement

This order is deemed to have come into force on 4 September 2010.

3 Principal order amended
4 Clause 6 amended

Clause 6(1) is amended by omitting “instead of” and substituting “in addition to the powers under”.

5 Clause 7 amended

Clause 7(1) is amended by omitting “instead of” and substituting “in addition to the powers under”.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This Order in Council is deemed to have come into force on 4 September 2010. It amends the Canterbury Earthquake (Resource Management Act) Order 2010 (which was also deemed to have come into force on 4 September 2010) to provide that the extension of time period under clause 6 of that order and the power to extend a time period under clause 7 of that order are in addition to, and not in substitution for, the powers under sections 37 and 37A of the Resource Management Act 1991.

This Order in Council is made under the Canterbury Earthquake Response and Recovery Act 2010 and its effect is temporary.

Issued under the authority of the Legislation Act 2012.
