These regulations are administered by the Ministry for Primary Industries.

Pursuant to section 297 of the Fisheries Act 1996, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

Regulations

1 Title

These regulations are the Fisheries (Satellite Vessel Monitoring) Amendment Regulations 2010.

2 Commencement

These regulations come into force on 16 December 2010.

3 Principal regulations amended
4 Interpretation

The definition of type approval in regulation 2 is revoked.

5 Regulation 5 revoked

Regulations 5 is revoked.

6 Registration of automatic location communicators

Regulation 6(1) is amended by omitting “is of the same type as a type approved under regulation 5 of these regulations” and substituting “complies with the standards and requirements specified under regulation 4(1)”.

7 Offences and penalties

Regulation 8(1)(b)(i) is amended by omitting “type approval granted in respect of the device” and substituting “standards and requirements specified by circular issued under regulation 4(1)”.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 16 December 2010, amend the Fisheries (Satellite Vessel Monitoring) Regulations 1993.

The amendments omit the requirement for automatic location communicators to be of an approved type, and substitute the requirement for them to comply with standards and requirements specified by circular issued under regulation 4(1) of the regulations.
