These regulations are administered by the Ministry of Social Development.

Pursuant to section 132AB of the Social Security Act 1964, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

Regulations

1 Title

These regulations are Social Security (Temporary Additional Support) Amendment Regulations 2011.

2 Commencement

These regulations come into force on the day after the date of their notification in the Gazette.

3 Principal regulations amended

These regulations amend the Social Security (Temporary Additional Support) Regulations 2005.

4 Cash assets defined

Regulation 8 is amended by revoking subclause (4) and substituting the following subclauses:

(3B)

Also, cash assets does not include any money paid to a person by the Earthquake Commission continued in existence by section 4(1) of the Earthquake Commission Act 1993, or by an insurance company,—

(a)

in respect of the destruction of or any damage to any property caused by the Canterbury earthquake; or

(b)

for or towards the costs of renting accommodation in place of residential premises destroyed or made uninhabitable by the Canterbury earthquake.

(3C)

In subclause (3B), Canterbury earthquake means the earthquake that occurred on 4 September 2010 in Canterbury, and includes all of its aftershocks.

(4)

Subclause (2) does not limit the generality of subclause (1); but subclauses (3) and (3B) override subclauses (1) and (2).

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force the day after notification in the Gazette, amend the Social Security (Temporary Additional Support) Regulations 2005 by excluding from the definition of cash assets in regulation 8 money paid to a person by the Earthquake Commission or an insurance company—

  • in respect of the destruction of or any damage to any property caused by the Canterbury earthquake; or

  • for or towards the costs of renting accommodation in place of residential premises destroyed or made uninhabitable by the Canterbury earthquake.
