This notice is administered by the Ministry of Health.

Pursuant to section 54 of the Health Practitioners Competence Assurance Act 2003, the Minister of Health, being satisfied of the matters set out in section 54(3) of that Act, gives the following notice.

1 Title

This notice is the Health Practitioners (Quality Assurance Activity—Royal Australasian College of Physicians Professional Qualities Reflection) Notice 2011.

2 Commencement

This notice comes into force on the day after the date of its notification in the Gazette.

3 Declaration of protected quality assurance activity

The Royal Australasian College of Physicians Professional Qualities Reflection Quality Assurance Activity described in the Schedule is a protected quality assurance activity.

1 Interpretation

In this schedule,—

activity means the activity described in clause 4

participant means a medical practitioner who is—

(a)

practising in New Zealand; and

(b)

training with the Royal Australasian College of Physicians to be a physician or a paediatrician; and

(c)

participating in the activity

professional qualities reflection means a written report, completed using the Professional Qualities Reflection Tool of the Royal Australasian College of Physicians, that—

(a)

identifies a significant incident; and

(b)

identifies, in relation to the significant incident, changes in the approach or to the behaviour of participants or other health practitioners that may influence the quality of care of an individual patient

significant incident means a process or practice undertaken by the participant or another health practitioner that is perceived by the participant to be relevant to his or her training and development.

2 Objective

The objective of the activity is to improve the practices, competence, and understanding of participants by requiring them to record and discuss their analyses of significant incidents that occur during their training.

3 Information

The activity is based on information derived from the participants.

4 Activity

The activity involves a participant—

(a)

completing, from time to time, a professional qualities reflection; and

(b)

discussing the professional qualities reflection with his or her educational supervisor or professional development adviser.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice, which comes into force on the day after the date of its notification in the Gazette, declares the Royal Australasian College of Physicians Professional Qualities Reflection Quality Assurance Activity to be a protected quality assurance activity. The effect of this declaration is that—

  • any information that becomes known solely as a result of the activity is confidential; and

  • any documents brought into existence solely for the purposes of the activity are confidential; and

  • the people who engage in the activity in good faith are immune from civil liability.

The protections afforded by this notice are subject to certain statutory exceptions. For example, this notice does not prohibit the disclosure of information that does not identify, either expressly or by implication, a particular individual.

This notice remains in force for a period of 5 years after the date on which it is issued, unless it is sooner revoked.
