This notice is administered by the Ministry of Health.

Pursuant to section 54 of the Health Practitioners Competence Assurance Act 2003, the Minister of Health, being satisfied of the matters set out in section 54(3) of that Act, gives the following notice.

Notice

1 Title

This notice is the Health Practitioners (Quality Assurance Activities—New Zealand Family Planning Association Incorporated) Notice 2011.

2 Commencement

This notice comes into force on the day after the date of its notification in the Gazette.

3 Declaration of protected quality assurance activities

Each of the following quality assurance activities described in the Schedule is a protected quality assurance activity:

(a)

Family Planning Association Client Record Audit Activity:

(b)

Family Planning Association Incident Audit Activity:

(c)

Family Planning Association Patient Care Activity:

(d)

Family Planning Association Peer Review Activity:

(e)

Family Planning Association Performance Audit Activity.

Schedule Description of quality assurance activities of New Zealand Family Planning Association Incorporated

1 Objective

The objective of each of the protected quality assurance activities is to improve the practices and competence of health practitioners engaged in the activity by assessing the health services performed by those health practitioners.

2 Information

The protected quality assurance activities are based on information derived from health practitioners who provide health services for or on behalf of New Zealand Family Planning Association Incorporated.

3 Family Planning Association Client Record Audit Activity

The Family Planning Association Client Record Audit Activity involves—

(a)

selecting randomly every 6 months a number of patients’ records; and

(b)

auditing those patients’ records with reference to a specific list of criteria; and

(c)

collating the results of the audit and entering those results onto a national summary sheet; and

(d)

discussing the results of the audit at meetings; and

(e)

making recommendations on how health practitioners who are engaging in the activity may improve their performance so as to improve the quality of care they provide.

4 Family Planning Association Incident Audit Activity

The Family Planning Association Incident Audit Activity involves—

(a)

entering in the Reportable Event Register—

(i)

all complaints received; and

(ii)

all clinical incidents involving a process or practice that resulted, or nearly resulted, or could have resulted, in an adverse outcome for 1 or more patients; and

(b)

reviewing the entries in the Register; and

(c)

notifying the National Clinical Services Director and National Medical and Nursing Advisors of any entries in the Register of a serious or critical nature; and

(d)

holding meetings, at an individual or group level, to discuss any entry in the Register to—

(i)

ascertain whether any improvements to clinical processes and practices may be made; and

(ii)

develop strategies to reduce the incidence of adverse outcomes; and

(e)

making recommendations on how health practitioners who are engaging in the activity can improve their performance so as to—

(i)

improve the quality of care they provide; and

(ii)

reduce the incidence of adverse outcomes; and

(f)

facilitating and implementing any such recommendations.

5 Family Planning Association Patient Care Activity

The Family Planning Association Patient Care Activity involves—

(a)

setting standards each year in relation to particular aspects of the patient care process; and

(b)

auditing clinical work against those standards to determine whether those standards have been achieved; and

(c)

collating the results of the audit; and

(d)

discussing the results of the audit at meetings; and

(e)

making recommendations on how health practitioners who are engaging in the activity may improve their performance so as to improve the quality of care they provide.

6 Family Planning Association Peer Review Activity

The Family Planning Association Peer Review Activity involves holding peer review meetings to discuss individual patient cases or clinical processes and practices of relevance to other participants.

7 Family Planning Association Performance Audit Activity

The Family Planning Association Performance Audit Activity involves—

(a)

developing performance review guidelines for all health practitioners engaged in the activity; and

(b)

undertaking annual performance reviews for all health practitioners engaged in the activity, which includes reviewing—

(i)

work responsibilities and performance (including direct observation of clinical consultations, professional standards, and work practices); and

(ii)

recent client records; and

(iii)

working relationships; and

(iv)

future planning to improve any deficiencies in competency or to extend the scope of the practice of individual health practitioners.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice, which comes into force on the day after the date of its notification in the Gazette, declares 5 quality assurance activities sponsored by the New Zealand Family Planning Association Incorporated to be protected quality assurance activities. The effect of this declaration is that—

  • any information that becomes known solely as a result of any of the activities is confidential; and

  • any documents brought into existence solely for the purposes of the activities are confidential; and

  • the persons who engage in the activities in good faith are immune from civil liability.

The protections afforded by this notice are subject to certain statutory exceptions. For example, this notice does not prohibit the disclosure of information that does not identify, either expressly or by implication, a particular individual.

Under section 54(4) of the Health Practitioners Competence Assurance Act 2003, this notice remains in force for a period of 5 years after the date on which it is issued, unless it is sooner revoked.
