This notice is administered by the Ministry of Health.

Pursuant to section 54 of the Health Practitioners Competence Assurance Act 2003, the Minister of Health, being satisfied of the matters set out in section 54(3) of that Act, gives the following notice.

Notice

1 Title

This notice is the Health Practitioners (Quality Assurance Activity—Hawke’s Bay DHB) Notice 2011.

2 Commencement

This notice comes into force on the day after the date of its notification in the Gazette.

3 Interpretation

In this notice, Hawke’s Bay DHB means the Hawke’s Bay District Health Board established by or under section 19 of the New Zealand Public Health and Disability Act 2000.

4 Declaration of quality assurance activity

The Hawke’s Bay DHB Quality Assurance Activity described in the Schedule is a protected quality assurance activity.

Schedule Description of Hawke’s Bay DHB Quality Assurance Activity

1 Interpretation

In this schedule,—

activity means the Hawke’s Bay DHB Quality Assurance Activity described in clause 4

participant means a health practitioner who is participating in the activity and—

(a)

is employed by Hawke’s Bay DHB; or

(b)

is not employed by Hawke’s Bay DHB, but who—

(i)

is authorised by Hawke’s Bay DHB to provide health services; or

(ii)

has an access agreement with Hawke’s Bay DHB; or

(iii)

is approved by Hawke’s Bay DHB to participate in the activity.

2 Objective

The objective of the activity is to improve the practices and competence of participants by assessing the health services performed by those participants.

3 Information

The activity is based on information derived from the participants.

4 Activity

The activity involves—

(a)

examining patients’ records; and

(b)

analysing the following data on patients:

(i)

admission and discharge; and

(ii)

morbidity and mortality; and

(iii)

outcomes of treatment; and

(c)

analysing the patient care process; and

(d)

identifying and analysing any process or practice that results in an outcome for patients that may, but need not, be an adverse outcome; and

(e)

presenting and discussing the results obtained under paragraphs (a) to (d); and

(f)

undertaking multi-disciplinary case reviews and peer reviews; and

(g)

reviewing—

(i)

patient management; and

(ii)

treatment decisions; and

(iii)

internal auditing of procedures; and

(h)

with regard to participants other than those described in paragraph (b)(iii) of the definition of participant in clause 1, making recommendations on how they can improve their performance so as to—

(i)

improve the quality of the care they provide; and

(ii)

reduce the incidence of adverse outcomes; and

(i)

facilitating and monitoring the implementation of any recommendations made under paragraph (h).

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice, which comes into force on the day after the date of its notification in the Gazette, declares the Hawke’s Bay DHB Quality Assurance Activity to be a protected quality assurance activity. The effect of this declaration is that—

  • any information that becomes known solely as a result of the activity is confidential; and

  • any documents brought into existence solely for the purposes of the activity are confidential; and

  • the persons who engage in the activity in good faith are immune from civil liability.

The protections afforded by this notice are subject to certain statutory exceptions. For example, this notice does not prohibit the disclosure of information that does not identify, either expressly or by implication, a particular individual.

Under section 54(4) of the Health Practitioners Competence Assurance Act 2003, this notice remains in force for a period of 5 years after the date on which it is issued, unless it is sooner revoked.
