Pursuant to sections 54 and 55(3) of the Customs and Excise Act 1996, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, and being of the opinion that the prohibition extended by this order is necessary in the public interest, makes the following order.

Order

1 Title

This order is the Customs Import Prohibition (Trout) Amendment Order 2012.

2 Commencement

This order comes into force on 7 November 2012.

Order: confirmed, on 18 December 2013, by section 10(a) of the Subordinate Legislation (Confirmation and Validation) Act 2013 (2013 No 142).

3 Principal order

This order amends the Customs Import Prohibition (Trout) Order 2010 (the principal order).

4 Clause 3 amended (Expiry)

In clause 3, replace “7 November 2012” with “7 November 2015”.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 7 November 2012, amends the Customs Import Prohibition (Trout) Order 2010 (the principal order) so that it expires on the close of 7 November 2015. The effect of this order is to extend for a further 3 years the prohibition on the importation of trout and trout products in quantities of 10 or more kilograms, or less than 10 kilograms if the goods are intended for sale, except with the consent of, and subject to such conditions as may be imposed by, the Minister of Conservation.

In accordance with section 54(5)(b) of the Customs and Excise Act 1996, this order expires on the close of 31 December 2013 unless it is expressly confirmed by Act of Parliament passed before that date. If confirmed in that way, this order expires on the close of 7 November 2015.
