Pursuant to section 7BA(2) of the Wildlife Act 1953, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.

Order

1 Title
  • This order is the Wildlife (Oceanic Whitetip Shark) Order 2012.

2 Commencement
  • This order comes into force on 3 January 2013.

3 Marine species declared to be animal
  • In Schedule 7A of the Wildlife Act 1953, under the heading “CHORDATA”, item relating to Chondrichthyes (cartilaginous fishes), insert in its appropriate alphabetical order the item set out in the Schedule of this order.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 3 January 2013, inserts a reference to oceanic whitetip shark in Schedule 7A of the Wildlife Act 1953 (the Act), which lists marine species declared to be animals. As a consequence, the oceanic whitetip shark is absolutely protected throughout New Zealand and New Zealand fisheries waters pursuant to section 3 of the Act.

In March 2012, the Western and Central Pacific Fisheries Commission adopted a prohibition on the taking of oceanic whitetip sharks. This order implements the prohibition in relation to New Zealand fisheries waters.
