Health Practitioners (Quality Assurance Activity—New Zealand Radiology Group Limited) Notice 2012

Pursuant to section 54 of the Health Practitioners Competence Assurance Act 2003, the Minister of Health, being satisfied of the matters set out in section 54(3) of that Act, gives the following notice.

1 Title

  • This notice is the Health Practitioners (Quality Assurance Activity—New Zealand Radiology Group Limited) Notice 2012.

2 Commencement

  • This notice comes into force on the day after the date of its notification in the Gazette.

3 Declaration of protected quality assurance activity

  • The New Zealand Radiology Group Limited Quality Assurance Activity described in the Schedule is a protected quality assurance activity.

Description of New Zealand Radiology Group Limited Quality Assurance Activity

1 Interpretation

  • In this schedule,—

    activity means the New Zealand Radiology Group Limited Quality Assurance Activity described in clause 4

    governing body means the committee comprising the medical director of New Zealand Radiology Group Limited and 2 senior radiologists employed by New Zealand Radiology Group Limited

    participant—

    • (a) means a health practitioner employed by New Zealand Radiology Group Limited who—

      • (i) is one of the following:

        • (A) a fellow of the Royal Australian and New Zealand College of Radiologists:

        • (B) an educational affiliate of the Royal Australian and New Zealand College of Radiologists:

        • (C) a medical radiation technologist:

        • (D) a diagnostic medical ultrasonographer; and

      • (ii) is participating in the activity; and

    • (b) includes a member of the review panel; but

    • (c) does not include a member of the governing body

    review panel means the panel of radiologists with postgraduate qualifications in radiology employed by New Zealand Radiology Group Limited.

2 Objective

  • The objective of the activity is to improve the practices and competence of participants involved in the activity by promoting the practice standards of diagnostic radiology and medical imaging performed by those participants.

3 Information

  • The activity is based on information derived from participants.

4 Activity

  • The activity involves—

    • (a) the review panel—

      • (i) reviewing the radiographs and associated reports of the participants; and

      • (ii) analysing differences between the diagnoses reported by the participants in respect of those radiographs and any subsequent clinical diagnosis; and

      • (iii) evaluating and reporting the results of the analysis under subparagraph (ii) to the governing body; and

    • (b) the governing body implementing any changes to practice standards that may be required as a result of analysis by the review panel to facilitate the improvement of medical imaging services provided by the participants.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice, which comes into force on the day after the date of its notification in the Gazette, declares the quality assurance activity called the New Zealand Radiology Group Limited Quality Assurance Activity to be a protected quality assurance activity. The effect of this declaration is that—

  • any information that becomes known solely as a result of the activity is confidential; and

  • any documents brought into existence solely for the purposes of the activity are confidential; and

  • the people who engage in the activity in good faith are immune from civil liability.

The protections afforded by this notice are subject to certain statutory exceptions. For example, this notice does not prohibit the disclosure of information that does not identify, either expressly or by implication, a particular individual.

Under section 54(4) of the Health Practitioners Competence Assurance Act 2003, this notice remains in force for a period of 5 years after the date on which it is issued, unless it is sooner revoked.

This notice revokes the Health Practitioners (Quality Assurance Activity—New Zealand Radiology Group Limited) Notice 2006, which has expired.
