This notice is administered by the Ministry for Primary Industries.

Pursuant to section 186A of the Fisheries Act 1996, the Minister for Primary Industries, after complying with the requirements of that section, gives the following notice.

Notice

1 Title

  • This notice is the Fisheries (Marsden Bank Temporary Closure) Notice 2012.

2 Commencement

  • This notice comes into force on 17 February 2013.

3 Revocation of this notice

  • This notice is revoked on the close of 16 February 2015.

4 Marsden Bank closed in respect of pipi for 2 years

  • (1) A person must not take pipi from Marsden Bank while this notice is in force.

    (2) In this clause,—

    Marsden Bank means all that area of New Zealand fisheries waters enclosed by a line—

    • (a) commencing at a point at the seaward end of the Marsden Point oil refinery jetty (at 35°50.21′S and 174°29.95′E); then

    • (b) proceeding in a generally easterly direction to the Port of Whangarei marker buoy 2 (at 35°50.31′S and 174°30.43′E); then

    • (c) proceeding in a generally south-westerly direction to a point offshore (at 35°50.65′S and 174°30.09′E); then

    • (d) proceeding in a generally north-westerly direction to a point on the mean high-water mark (at 35°50.58′S and 174°30.00′E); then

    • (e) proceeding along the mean high-water mark to the Marsden Point oil refinery jetty (at 35°50.24′S and 174°29.91′E); then

    • (f) proceeding in a generally north-easterly direction along the Marsden Point oil refinery jetty to the point of commencement

    pipi means a shellfish of the species Paphies australis.

5 Revocation of Fisheries (Marsden Bank Temporary Closure) Notice 2011

This note is not part of the notice, but is intended to indicate its general effect.

This notice, which comes into force on 17 February 2013, prohibits the taking of pipi from Marsden Bank for a period of 2 years.
