Pursuant to sections 74C and 75C of the War Pensions Act 1954, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.

Order

1 Title

  • This order is the War Pensions (Rates of Pensions, Lump Sum Payments, and Allowances) Order 2013.

2 Commencement

  • (1) This order (except clause 5 and Schedule 2) comes into force on 1 April 2013.

    (2) Clause 5 and Schedule 2 come into force immediately after the commencement of the rest of this order.

    Order: validated and confirmed, on 18 December 2013, by section 15 of the Subordinate Legislation (Confirmation and Validation) Act 2013 (2013 No 142).

3 Date from which order to have effect

  • This order has effect from 31 March 2013 (that is to say, at the beginning of 1 April 2013).

4 Increasing rates of pensions, lump sum payments, and allowances to reflect changes in Consumers Price Index (All Groups)

  • (1) In each provision of the War Pensions Act 1954 listed in column 1 of Schedule 1, replace the amount opposite that provision in column 2 with the amount opposite that provision in column 3.

    (2) The amendments made by subclause (1) to Schedule 12 of the War Pensions Act 1954 apply only in respect of people who die on or after 1 April 2013.

5 Further increases to certain amounts

  • (1) In the War Pensions Act 1954, Schedule 11, clauses 1(a) to (c) and 2(a) and (b) (as replaced by clause 4(1) and Schedule 1 of this order), increase those amounts in the manner provided in subclause (2) of this clause.

    (2) In each provision of Schedule 11 of the War Pensions Act 1954 listed in column 1 of Schedule 2 of this order, replace the amount opposite that provision in column 2 with the amount opposite that provision in column 3.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 1 April 2013, amends the War Pensions Act 1954 in 2 ways.

First, clause 4 and Schedule 1 increase the following by 0.61% (reflecting the increase in the New Zealand Consumers Price Index (All Groups) excluding cigarettes and other tobacco products):

  • the maximum rate of a disablement pension:

  • the maximum rate of an additional pension for severe disablement:

  • clothing allowances:

  • the maximum rate of allowance for the services of attendants for disabled pensioners:

  • the maximum rate of surviving spouses' or surviving partners' pensions:

  • the maximum rates of additional parents' allowances payable to a surviving spouse or surviving partner:

  • the maximum rate of children's pensions in ordinary cases:

  • the maximum rate of war orphans' pensions:

  • the maximum rates of veterans' pensions:

  • the maximum payments on the death of a veteran or a veteran's spouse, civil union partner, or de facto partner.

Secondly, clause 5 and Schedule 2 make some additional increases to figures already increased by clause 4 and Schedule 1 in order to honour the Government's commitments in relation to the level of veterans' pensions.
