Pursuant to section 71 of the Canterbury Earthquake Recovery Act 2011, His Excellency the Governor-General makes the following order, acting—

(a)

on the advice and with the consent of the Executive Council; and

(b)

on the recommendation of the relevant Minister following the Canterbury Earthquake Recovery Review Panel’s review of the draft order.

Order

1 Title

This order is the Canterbury Earthquake (Local Government Act 2002) Order (No 2) 2011 Amendment Order 2013.

2 Commencement

This order comes into force on 22 March 2013.

3 Principal order

This order amends the Canterbury Earthquake (Local Government Act 2002) Order (No 2) 2011 (the principal order).

4 Expiry

This order expires on the close of 1 July 2015.

5 Clause 4 amended (Interpretation)

In clause 4(1), definition of council, delete “the Christchurch City Council,”.

6 Clause 5 amended (Application of clause 6)

In clause 5, delete “the Christchurch City Council,”.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which amends the Canterbury Earthquake (Local Government Act 2002) Order (No 2) 2011 (the principal order), comes into force on 22 March 2013 and expires on the close of 1 July 2015 when the principal order expires.

The principal order—

  • applies to the Christchurch City Council, the Canterbury Regional Council, the Selwyn District Council, and the Waimakariri District Council; and

  • modifies the application to them of certain provisions in the Local Government Act 2002 relating to long-term plans, annual plans, and annual reports.

The amendments delete references to the Christchurch City Council. The effect of this is that the principal order ceases to apply to the Christchurch City Council.

For the extent to which those provisions of the Local Government Act 2002 continue to apply to the Christchurch City Council, see the Canterbury Earthquake (Local Government Act 2002—Christchurch City 3-Year Plan) Order 2013.

As is the case with the principal order, this amendment order is made under the Canterbury Earthquake Recovery Act 2011 and its effect is temporary.
