This notice is administered by the Ministry of Health.

Pursuant to section 54 of the Health Practitioners Competence Assurance Act 2003, the Minister of Health, being satisfied of the matters set out in section 54(3) of that Act, gives the following notice.

1 Title

This notice is the Health Practitioners (Quality Assurance Activity—MidCentral DHB) Notice 2013.

2 Commencement

This notice comes into force on the day after the date of its notification in the Gazette.

3 Declaration of protected quality assurance activity

The MidCentral DHB Quality Assurance Activity described in the Schedule is a protected quality assurance activity.

Schedule Description of MidCentral DHB Quality Assurance Activity

1 Interpretation

In this schedule,—

activity means the MidCentral DHB Quality Assurance Activity described in clause 4

participant means the following persons participating in the activity:

(a)

a health practitioner who is employed by MidCentral DHB or authorised by MidCentral DHB to provide perinatal health services:

(b)

lead maternity carers who have access agreements with MidCentral DHB:

(c)

any other person connected with the women’s health service at MidCentral DHB (for example, a social worker or member of the Police).

2 Objective

The objective of the activity is to improve the practices and competence of health practitioners providing perinatal health services at MidCentral DHB.

3 Information

The activity is based on information derived from participants.

4 Activity

The activity involves—

(a)

midwives (as overseen by the midwifery educator) collecting and collating, in respect of all perinatal case reviews by health practitioners at MidCentral DHB, information on serious morbidity and mortality; and

(b)

the midwifery educator or perinatal and maternity mortality review committee co-ordinator preparing reports on the basis of the information referred to in paragraph (a); and

(c)

participants attending meetings convened to review perinatal cases and to discuss issues arising from the reports referred in paragraph (b); and

(d)

the perinatal and maternity mortality review committee co-ordinator making recommendations on how—

(i)

improvements can be made to the quality of MidCentral DHB’s perinatal services, policies, and guidelines and how such improvements can be completed within appropriate time frames, involve relevant participants, and be implemented and monitored; and

(ii)

to provide education and feedback to other health professionals working at MidCentral DHB through appropriate meetings.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice, which comes into force on the day after the date of its notification in the Gazette, declares the MidCentral DHB Quality Assurance Activity to be a protected quality assurance activity. The effect of this declaration is that—

  • any information that becomes known solely as a result of the activity is confidential; and

  • any documents brought into existence solely for the purposes of the activity are confidential; and

  • the persons who engage in the activity in good faith are immune from civil liability.

The protections afforded by this notice are subject to certain statutory exceptions. For example, this notice does not prohibit the disclosure of information that does not identify, either expressly or by implication, a particular individual.

Under section 54(4) of the Health Practitioners Competence Assurance Act 2003, this notice remains in force for a period of 5 years after the date on which it is issued, unless it is sooner revoked.

This notice revokes the Health Practitioners (Quality Assurance Activity: MidCentral Health) Notice 2005 because the MidCentral Health Quality Assurance Activity has ceased to be a protected quality assurance activity.
