Fisheries (Interim and Annual Deemed Values) Notice 2003 Amendment Notice 2013: revoked, on 29 September 2015, pursuant to clause 9(1) of the Fisheries (Total Allowable Catch, Total Allowable Commercial Catch, and Deemed Value Rates) Notice 2015 (LI 2015/211).

Pursuant to section 75 of the Fisheries Act 1996, the Minister for Primary Industries gives the following notice after complying with the requirements in sections 75 and 75A of that Act.

Notice

1 Title

This notice is the Fisheries (Interim and Annual Deemed Values) Notice 2003 Amendment Notice 2013.

2 Commencement

This notice comes into force on 30 September 2013.

3 Application

This notice applies on and from the first day of the fishing year starting on 1 October 2013.

4 Principal notice

This notice amends the Fisheries (Interim and Annual Deemed Values) Notice 2003 (the principal notice).

5 Clause 6 amended (Annual deemed values)

(1)

In clause 6(a)(i), delete “leatherjacket (except for LEA3),”.

(2)

In clause 6(a)(ii), after “individual stocks”, insert “LEA10,”.

(3)

In clause 6(a)(ii), delete “SPE5, SPE6, SPE8, SPE9,”.

6 Clause 7 amended (Different deemed values for Chatham Islands)

In clause 7(2), replace “Except in the case of sea perch and trumpeter, clause 6(b)” with “Clause 6(b)”.

7 Schedule 1 amended

In Schedule 1, for each item relating to a fishstock code for which there is a corresponding item in Schedule 1 of this notice, replace the item with the corresponding item.

8 Schedule 1A amended

In Schedule 1A, insert in their appropriate alphanumerical order the items set out in Schedule 2 of this notice.

9 Schedule 2 amended

In Schedule 2, revoke the items relating to the fishstock codes SPE4 and STA4.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice amends the Fisheries (Interim and Annual Deemed Values) Notice 2003 (the principal notice). It comes into force on 30 September 2013 and applies to and from the fishing year starting on 1 October 2013.

The amendments replace or insert interim and annual deemed values for various fishstocks.

The amendments also have the following effects:

  • KIN7 and LEA3 become fishstocks whose annual deemed values are set by clause 6(ab) of the principal notice:

  • LEA1, LEA2, LEA4, SPE4 (in the Chatham Islands), SPE5, SPE6, SPE8, SPE9, and TRU4 (in the Chatham Islands) become fishstocks whose annual deemed values are set by clause 6(b) of the principal notice.
