Road User Charges Amendment Regulations 2014

Pursuant to section 89 of the Road User Charges Act 2012, Her Excellency the Administrator of the Government, acting on the advice and with the consent of the Executive Council, makes the following regulations.

Regulations

1 Title

  • These regulations are the Road User Charges Amendment Regulations 2014.

2 Commencement

  • These regulations come into force on 1 July 2014.

3 Principal regulations
4 Regulation 3 amended (Interpretation)

  • In regulation 3(1), insert in its appropriate alphabetical order:

    “motor caravan—

    • “(a)  means a motor vehicle that—

      • “(i) has more than one-half of the vehicle floor area permanently fitted out for accommodation by the inclusion of sleeping and cooking facilities; and

      • “(ii) is registered as a motor caravan on the register of motor vehicles maintained under section 234 of the Land Transport Act 1998; but

    • “(b) does not include a combination vehicle”.

5 Schedule amended

  • (1) In the Schedule, Part 1, item relating to RUC vehicle type number 6, third column, replace “or 399” with “399, or 413”.

    (2) In the Schedule, Part 1, after the item to relating to RUC vehicle type number 6, insert:

    413 RUC weight of more than 18 000 kg  Motor caravan with 3 axles
    414 Any RUC weight Motor caravan with 4 axles

    (3) In the Schedule, Part 1, item relating to RUC vehicle type number 14, third column, replace “or 499” with “, 414, or 499”.

    (4) In the Schedule, Part 2, replace the items relating to Type H vehicle type numbers H38 and H39 with:

    H75 Towing vehicle that is part of an overweight combination vehicle consisting of a type 6 RUC vehicle towing a type 951 RUC vehicle with a permit weight of not more than 48 000 kg
    H76 Towing vehicle that is part of an overweight combination vehicle consisting of a type 6 RUC vehicle towing a type 951 RUC vehicle with a permit weight of more than 48 000 kg but not more than 53 000 kg

    (5) In the Schedule, Part 2, after the item relating to Type H vehicle number H37, insert:

    H38 Towing vehicle that is part of an overweight combination vehicle consisting of a type 19 RUC vehicle towing a type 951 RUC vehicle with a permit weight of more than 60 000 kg but not more than 63 000 kg

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 July 2014, amend the Road User Charges Regulations 2012 (the principal regulations), by—

  • inserting a new definition of motor caravan, which relates to the descriptions of new RUC vehicle types 413 and 414 (as inserted into Part 1 of the Schedule of the principal regulations by these regulations):

  • amending the Schedule, which prescribes RUC vehicle types and RUC weight bands for RUC vehicles (including type H vehicles). The changes—

    • prescribe new RUC vehicle type numbers 413 and 414 for motor caravans with 3 axles and 4 axles in Part 1 of the Schedule; and

    • consequentially amend current RUC vehicle type numbers 6 and 14 in Part 1 of the Schedule to exclude motor caravans with 3 axles and 4 axles from the description of those RUC vehicles; and

    • prescribe a new type H vehicle number H38 in Part 2 of the Schedule; and

    • renumber the current type H vehicle type numbers H38 and H39 as H75 and H76 in Part 2 of the Schedule.

The effect of the amendments is that rates of road user charges may be specified for these RUC vehicles in regulations made under section 85 of the Road User Charges Act 2012.
