Minimum Wage Amendment Order 2014: revoked, on 1 April 2015, pursuant to clause 7 of the Minimum Wage Order 2015 (LI 2015/40).

This order is administered by the Ministry of Business, Innovation, and Employment.

Pursuant to sections 4, 4A, and 4B of the Minimum Wage Act 1983, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.

Order

1 Title

This order is the Minimum Wage Amendment Order 2014.

2 Commencement

This order comes into force on the 28th day after the date of its notification in the Gazette.

3 Principal order

This order amends the Minimum Wage Order 2014 (the principal order).

4 Clause 4 amended (Minimum adult rates)

(1)

In clause 4(c), replace “in all other cases” with “for an adult worker paid by the week”.

(2)

After clause 4(c), insert:

(d)

in all other cases,—

(i)

$1,140 per fortnight; and

(ii)

$14.25 per hour for each hour exceeding 80 hours worked by a worker in a fortnight.

5 Clause 5 amended (Minimum starting-out rates)

(1)

In clause 5(c), replace “in all other cases” with “for a starting-out worker paid by the week”.

(2)

After clause 5(c), insert:

(d)

in all other cases,—

(i)

$912 per fortnight; and

(ii)

$11.40 per hour for each hour exceeding 80 hours worked by a starting-out worker in a fortnight.

6 Clause 6 amended (Minimum training rates)

(1)

In clause 6(c), replace “in all other cases” with “for a trainee paid by the week”.

(2)

After clause 6(c), insert:

(d)

in all other cases,—

(i)

$912 per fortnight; and

(ii)

$11.40 per hour for each hour exceeding 80 hours worked by a trainee in a fortnight.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on the 28th day after the date of its notification in the Gazette, amends the Minimum Wage Order 2014, which prescribes minimum rates of wages payable to adult workers, starting-out workers, and trainees. The amendments to clauses 4, 5, and 6 prescribe a fortnightly minimum rate of wages for those workers who are not paid by the hour or by piecework, by the day, or by the week.

The Ministry of Business, Innovation, and Employment produced a regulatory impact statement on 22 May 2014 to help inform the decisions taken by the Government relating to the contents of this order.
