This notice is administered by the Ministry of Health.

Pursuant to section 54 of the Health Practitioners Competence Assurance Act 2003, the Minister of Health, being satisfied of the matters set out in section 54(3) of that Act, gives the following notice.

1 Title

This notice is the Health Practitioners (Quality Assurance Activity—MercyAscot Hospitals) Notice 2014.

2 Commencement

This notice comes into force on the day after the date of its notification in the Gazette.

3 Revocation of this notice

This notice is revoked at the end of the period for which it remains in force under section 54(4) of the Health Practitioners Competence Assurance Act 2003.

4 Declaration of protected quality assurance activity

The MercyAscot Hospitals Quality Assurance Activity described in the Schedule is a protected quality assurance activity.

Schedule Description of MercyAscot Hospitals Quality Assurance Activity

1 Interpretation

In this schedule,—

activity means the MercyAscot Hospitals Quality Assurance Activity

MercyAscot Hospitals means—

(a)

Mercy Hospital, Epsom, Auckland; and

(b)

Ascot Hospital, Remuera, Auckland; and

(c)

Mercy Endoscopy, Epsom and North Shore, Auckland

participant means a health practitioner who provides services at MercyAscot Hospitals.

2 Objective

The objective of the activity is to improve the practices and competence of participants by assessing the health services they perform.

3 Information

The activity is based on information derived from the participants.

4 Activity

The activity involves—

(a)

examining patients’ records; and

(b)

analysing the following data on patients:

(i)

admission and discharge; and

(ii)

morbidity; and

(iii)

mortality; and

(iv)

unplanned returns to theatre; and

(v)

infection rates; and

(vi)

outcomes of treatment (for example, the outcomes of implants); and

(c)

identifying and analysing adverse outcomes; and

(d)

comparing the results of the analysis under paragraph (c) with internal and external benchmarking standards; and

(e)

assessing and peer-reviewing the performance and competence of participants; and

(f)

making recommendations on how participants can improve their performance so as to—

(i)

improve the quality of care they provide; and

(ii)

reduce the incidence of adverse outcomes; and

(g)

facilitating and monitoring the implementation of recommendations described in paragraph (f); and

(h)

preparing documentation and gathering information on adverse outcomes; and

(i)

holding meetings to discuss—

(i)

the results obtained under paragraphs (a) to (g); and

(ii)

the documentation prepared from the information gathered under paragraph (h).

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice comes into force on the day after the date of its notification in the Gazette. It declares the MercyAscot Hospitals Quality Assurance Activity to be a protected quality assurance activity. The effect of this declaration is that, subject to certain exceptions,—

  • any information that becomes known solely as a result of the activity is confidential; and

  • any documents brought into existence solely for the purposes of the activity are confidential; and

  • the persons who engage in the activity in good faith are immune from civil liability.

Under section 54(4) of the Health Practitioners Competence Assurance Act 2003, this notice remains in force for a period of 5 years after the date on which it is issued unless it is sooner revoked.

This notice revokes the Health Practitioners (Quality Assurance Activity—MercyAscot Hospitals) Notice 2009.
