Explanatory note
This note is not part of the notice, but is intended to indicate its general effect.
This notice, which comes into force on the 28th day after the date of its notification in the Gazette, is made under the Fisheries (South Island Customary Fishing) Regulations 1999 (the regulations). This notice declares the area described in clause 3 to be a mātaitai reserve. A mātaitai reserve is an identified traditional fishing ground managed by the tangata whenua through Tangata Tiaki/Kaitiaki. Commercial fishing is generally prohibited in a mātaitai reserve (with exceptions specified in regulation 24 of the regulations). The Tangata Tiaki/Kaitiaki of a mātaitai reserve may authorise any individual to take fisheries resources for customary food gathering purposes from within the whole or any part of the mātaitai reserve.The Minister’s appointment of the Tangata Tiaki/Kaitiaki for the Motupōhue Mātaitai Reserve is to be notified by the Director-General of the Ministry for Primary Industries in accordance with regulation 22 of the regulations.
