This notice is administered by the Ministry for Primary Industries.

Pursuant to regulation 9 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Director-General of the Ministry for Primary Industries, after compliance with the requirements set out in regulation 9 of those regulations, gives the following notice.

1 Title

This notice is the Fisheries (Reappointment of Te Rūnanga o Ngāti Waewae Tangata Tiaki/Kaitiaki) Notice 2014.

2 Commencement

This notice comes into force on the day after the date of its notification in the Gazette.

3 Customary food gathering areas/rohe moana

This notice applies to the following customary food gathering areas/rohe moana:

(a)

the area/rohe moana from the Hokitika River to the Kawatiri/Buller River, extending seaward to the limit of the South Island fisheries waters and inland to the boundaries of the Te Runaka o Kati Waewae takiwa as defined in the Schedule of the Te Runanga o Ngai Tahu (Declaration of Membership) Order 2001; and

(b)

the area/rohe moana from the Kawatiri/Buller River to Kahurangi Point, extending seaward to the limit of the South Island fisheries waters and inland to the boundaries of the Te Runaka o Kati Waewae takiwa as defined in the Schedule of the Te Runanga o Ngai Tahu (Declaration of Membership) Order 2001.

4 Reappointment

(1)

The Minister for Primary Industries has appointed Francois Tumahai for a further term as a Tangata Tiaki/Kaitiaki of the customary food gathering areas/rohe moana.

(2)

The appointment—

(a)

took effect on 14 August 2014; and

(b)

expires at the close of 13 August 2019.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice, which comes into force on the day after the date of its notification in the Gazette, is made under regulation 9 of the Fisheries (South Island Customary Fishing) Regulations 1999 (the regulations).

The notice relates to 2 customary food gathering areas/rohe moana for which the members of Te Rūnanga o Ngāti Waewae hold mana whenua and mana moana. It gives notice of the Minister for Primary Industries’ decision to reappoint Francois Tumahai for a further term as a Tangata Tiaki/Kaitiaki of those 2 areas/rohe moana.

The Minister made the decision at the request of Te Rūnanga o Ngāti Waewae, in accordance with regulation 9(5) of the regulations.

Tangata Tiaki/Kaitiaki may, within their area/rohe moana, authorise individuals to take, for customary food gathering purposes, fisheries resources managed under the Fisheries Act 1996. It is an offence to take those resources for customary food gathering purposes without such authorisation.
