This notice is administered by the Ministry for Primary Industries.

Pursuant to regulations 9 and 10 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Director-General of the Ministry for Primary Industries, after compliance with the requirements of those provisions, gives the following notice.

1 Title

This notice is the Fisheries (Notification of Te Rūnanga o Makaawhio Tangata Tiaki/Kaitiaki) Notice 2014.

2 Commencement

This notice comes into force on the day after the date of its notification in the Gazette.

3 Revocation of this notice

This notice is revoked at the close of 3 September 2019.

4 Customary food gathering area/rohe moana

This notice applies to the customary food gathering area/rohe moana from Piopiotahi (Milford Sound) to Abut Head, extending seaward to the limit of the South Island fisheries waters and inland to the boundaries of the takiwā of Te Rūnanga o Makaawhio (as described in the Schedule of the Te Runanga o Ngai Tahu (Declaration of Membership) Order 2001).

5 Appointment cancelled

(1)

The Minister for Primary Industries has cancelled the appointment of Thomas Rochford as a Tangata Tiaki/Kaitiaki of the customary food gathering area/rohe moana.

(2)

The cancellation took effect at the close of 21 August 2014.

6 Reappointment

(1)

The Minister for Primary Industries has appointed Robert Wilson for a further term as a Tangata Tiaki/Kaitiaki of the customary food gathering area/rohe moana.

(2)

The appointment—

(a)

took effect on 4 September 2014; and

(b)

expires at the close of 3 September 2019.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice, which comes into force on the day after the date of its notification in the Gazette, is made under regulations 9 and 10 of the Fisheries (South Island Customary Fishing) Regulations 1999 (the regulations). It is revoked at the close of 3 September 2019.

The notice relates to a customary food gathering area/rohe moana of which the members of Te Rūnanga o Makaawhio are the tangata whenua. It gives notice of the Minister for Primary Industries’ decision to—

  • cancel the appointment of Thomas Rochford as a Tangata Tiaki/Kaitiaki of the area/rohe moana; and

  • reappoint Robert Wilson for a further term as a Tangata Tiaki/Kaitiaki of the area/rohe moana.

The Minister made the decisions at the request of Te Rūnanga o Makaawhio, in accordance with regulations 9(5) and 10(1) of the regulations.

Tangata Tiaki/Kaitiaki may, within their area/rohe moana, authorise individuals to take, for customary food gathering purposes, fisheries resources managed under the Fisheries Act 1996. It is an offence to take those resources for customary food gathering purposes without such authorisation.
