Pursuant to section 5 of the Health Sector (Transfers) Act 1993, His Excellency the Governor-General makes the following order, acting—

(a)

on the advice and with the consent of the Executive Council; and

(b)

on the recommendation of the transferring Ministers.

Order

1 Title

This order is the Health Sector Transfers (Canterbury DHB) Order 2015.

2 Commencement

This order comes into force on 30 June 2015.

3 Interpretation

In this order, proposal means the proposal set out in the Schedule, but including the appendix (of plant and equipment) to the proposal as signed by the transferring Ministers.

4 Approval of proposal

The proposal is approved.

5 Date on which proposal takes effect

The proposal takes effect on 30 June 2015.

Schedule Proposal for transfer of assets from Hawke’s Bay DHB to Canterbury DHB

1 Background

This proposal has been prepared in accordance with section 5 of the Health Sector (Transfers) Act 1993 for the purpose of transferring assets of Hawke’s Bay DHB located at 6 Comflat Road, Chatham Islands, and at Hospital Road, Chatham Islands, to Canterbury DHB. Responsibility for the provision of health care services in the Chatham Islands is to be transferred from Hawke’s Bay DHB to Canterbury DHB (by way of boundary change).

2 Transferor

The transferor is Hawke’s Bay DHB.

3 Transferee

The transferee is Canterbury DHB.

4 Description of assets to be transferred

The assets to be transferred to the transferee are—

(a)

846 square metres, more or less, with legal description Lot 11 Deposited Plan 74262, held in computer register WN41B/635 (6 Comflat Road):

(b)

9.4418 hectares, more or less, with legal description Kekerione 1 Subdivision 62 Block, held in computer register WN370/115 (Hospital Road):

(c)

plant and equipment located on the above properties as described in Appendix 1 to this proposal (as it was signed).

5 Value attributed to assets for purpose of transfer

For the purpose of the transfer, the value attributed to the assets to be transferred from Hawke’s Bay DHB is $1,655,000 as at 15 December 2014.

6 Transfer of assets without consideration

The transferor is to transfer the assets referred to in clause 4 without receiving any asset in return.

7 Transfer date

The transfer date is 30 June 2015.

8 Date and execution

This proposal is dated 18 May 2015 and is signed by the transferring Ministers, Simon William English, Minister of Finance, and Jonathan David Coleman, Minister of Health.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order comes into force on 30 June 2015. It transfers land, and associated plant and equipment, at 6 Comflat Road and Hospital Road, Chatham Islands, from Hawke’s Bay DHB to Canterbury DHB.

The Chatham Islands Territory is removed from the geographical area of Hawke’s Bay DHB and added to the geographical area of Canterbury DHB by a related order (the Health and Disability (Geographical Areas of DHBs) Order 2015).

1 General
