Pursuant to regulations 22 and 23 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Minister for Primary Industries gives the following notice.

Notice

1 Title

This notice is the Fisheries (Notification of Tāngata Tiaki/Kaitiaki for Mātaitai Reserve at Lake Forsyth (Wairewa)) Notice 2015.

2 Commencement

This notice comes into force on the day after the date of its notification in the Gazette.

3 Revocation of this notice

This notice is revoked on 8 July 2020.

4 Mātaitai reserve

This notice applies to the mātaitai reserve at Lake Forsyth (Wairewa) that was declared by the Fisheries (Declaration of Wairewa/Lake Forsyth Mātaitai Reserve and Appointment of Tangata Tiaki/Kaitiaki) Notice 2010 (Gazette 2010, p 1849).

5 Appointment cancelled

(1)

The Minister for Primary Industries has cancelled the appointment of John Boyles as a Tangata Tiaki/Kaitiaki for the mātaitai reserve.

(2)

The cancellation takes effect at the end of 7 July 2015.

6 Reappointments

(1)

The Minister for Primary Industries has appointed the following people for a further term as Tāngata Tiaki/Kaitiaki for the mātaitai reserve:

The appointments—

(a)

take effect on 8 July 2015; and

(b)

expire at the end of 7 July 2020.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice is made under the Fisheries (South Island Customary Fishing) Regulations 1999 (the regulations). It comes into force on the day after the date of its notification in the Gazette and revokes itself on 8 July 2020.

This notice relates to the mātaitai reserve at Lake Forsyth (Wairewa).

Notice is given of—

  • the cancellation of the appointment of a Tangata Tiaki/Kaitiaki for the mātaitai reserve:

  • the reappointment of 5 Tāngata Tiaki/Kaitiaki for the mātaitai reserve.

The Minister for Primary Industries cancelled the appointment under regulation 23(1) of the regulations and made the reappointments under regulation 22(3) of the regulations. The Minister took these actions at the request of the Wairewa Rūnanga, which represents the tangata whenua of the area that includes the mātaitai reserve.

The Tāngata Tiaki/Kaitiaki for the mātaitai reserve may—

  • ask the Minister to recommend the making of regulations to allow commercial fishing of certain species within the mātaitai reserve:

  • make bylaws restricting or prohibiting the taking of fish, aquatic life, or seaweed from within the mātaitai reserve:

  • authorise the continued taking of fish, aquatic life, or seaweed from within the mātaitai reserve for purposes that sustain the functions of a marae:

  • authorise the relocation of fish, aquatic life, or seaweed within the mātaitai reserve for the purpose of enhancing stocks.
