Pursuant to regulation 22 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Minister for Primary Industries gives the following notice.

Notice

1 Title

This notice is the Fisheries (Notification of Tāngata Tiaki/Kaitiaki for Mātaitai Reserve at Kaihuka Island) Notice 2015.

2 Commencement

This notice comes into force on the day after the date of its notification in the Gazette.

3 Revocation of this notice

This notice is revoked on 1 August 2020.

4 Mātaitai reserve

This notice applies to the mātaitai reserve at Kaihuka Island, on the east side of Stewart Island, that was declared by the Fisheries (Declaration of Kaihuka Mātaitai Reserve and Appointment of Tangata Tiaki/Kaitiaki) Notice 2010 (Gazette 2010, p 1851).

5 Reappointment

The Minister for Primary Industries has appointed Gail Thompson for a further term of 5 years as a Tangata Tiaki/Kaitiaki for the mātaitai reserve.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice is made under the Fisheries (South Island Customary Fishing) Regulations 1999 (the regulations). It comes into force on the day after the date of its notification in the Gazette and revokes itself on 1 August 2020.

This notice relates to the mātaitai reserve at Kaihuka Island, on the east side of Stewart Island.

Notice is given of the reappointment of a Tangata Tiaki/Kaitiaki for the mātaitai reserve. The earlier appointment expired at the end of 7 July 2015. The Minister reappointed the Tangata Tiaki/Kaitiaki under regulation 22(3) of the regulations at the request of Te Rūnanga o Awarua, which represents the tangata whenua of the area that includes the mātaitai reserve.

The Tāngata Tiaki/Kaitiaki for a mātaitai reserve may—

  • ask the Minister to recommend the making of regulations to allow commercial fishing of certain species within the mātaitai reserve:

  • make bylaws restricting or prohibiting the taking of fish, aquatic life, or seaweed from within the mātaitai reserve:

  • authorise the continued taking of fish, aquatic life, or seaweed from within the mātaitai reserve for purposes that sustain the functions of a marae:

  • authorise the relocation of fish, aquatic life, or seaweed within the mātaitai reserve for the purpose of enhancing stocks.
