Pursuant to section 297 of the Fisheries Act 1996, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.
These regulations are the Fisheries (Central Area Commercial Fishing) Amendment Regulations 2015.
These regulations come into force on 20 December 2015.
These regulations amend the Fisheries (Central Area Commercial Fishing) Regulations 1986 (the principal regulations).
In regulation 12(4), replace “due west of the mean high-water mark between the Waikanae River mouth (at 40°52.4′S and 175°00.4′E) and Turakirae Head (at 41°25.93′S and 174°55.10′E); and including those waters lying within 2 nautical miles of Mana Island (at 41°05.3′S and 174°47′E) and Kapiti Island (at 40°51.5′S and 174°55′E)” with “of the south-west coast of the North Island that are south of a line that proceeds due west from a point on the mean high-water mark of the Waikanae River mouth (at 40°52.4′S and 175°00.4′E); and west of a line that proceeds due south from a point on the mean high-water mark of Turakirae Head (at 41°25.93′S and 174°55.10′E); and including those waters lying within 2 nautical miles of the mean high-water mark of Kapiti Island”.

This note is not part of the regulations, but is intended to indicate their general effect.
These regulations amend the Fisheries (Central Area Commercial Fishing) Regulations 1986 (the principal regulations) and come into force on 20 December 2015.
The Waikanae River mouth area is the subject of a shellfish prohibition under regulation 12 of the principal regulations. These regulations correct the description of the area to reflect what is commonly understood and is shown on most publicly available maps of the area.
