Pursuant to sections 65 and 287A of the Customs and Excise Act 1996, Her Excellency the Administrator of the Government makes the following regulations, acting—

(a)

on the advice and with the consent of the Executive Council; and

(b)

to the extent that these regulations prescribe goods deemed to be the produce or manufacture of a country or group of countries for the purposes of the Tariff Act 1988, on the recommendation of the Minister of Customs made after consultation with the Minister of Commerce.

Regulations

1 Title

These regulations are the Customs and Excise (Rules of Origin for Republic of Korea FTA Goods) Amendment Regulations 2015.

2 Commencement

These regulations come into force on 20 December 2015.

3 Principal regulations

These regulations amend the Customs and Excise Regulations 1996 (the principal regulations).

4 New regulations 51ZZC and 51ZZD and cross-heading inserted

51ZZC Interpretation

In this regulation and regulation 51ZZD, unless the context otherwise requires,—

Harmonised System has the same meaning as in regulation 2(1)

HS 2007 means the Harmonised System 2007

HS 2012 means the Harmonised System 2012

Republic of Korea FTA means the Free Trade Agreement between New Zealand and the Republic of Korea done at Seoul on 23 March 2015.

51ZZD Originating goods

Particular goods are deemed for the purposes of the Act and the Tariff Act 1988 to be the produce or manufacture of the Republic of Korea if the goods meet all applicable requirements set out in the following provisions of the Republic of Korea FTA:

(a)

Chapter 3 (pages 3-1 to 3-15, which deals with rules of origin and origin procedures); and

(b)

Annex 3-A (made up of the headnote to Annex-3A (pages 3-A-1 and 3-A-2) and the Product Specific Rules Schedule), but with the variations to Annex 3-A (to transpose those Rules’ Tariff item references from HS 2007 to HS 2012) specified in Schedule 9 of these regulations.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 20 December 2015, amend the Customs and Excise Regulations 1996 (the principal regulations) to prescribe rules of origin and product specific rules for goods imported from the Republic of Korea. The rules of origin and product specific rules give effect to the Free Trade Agreement between New Zealand and the Republic of Korea done at Seoul, Korea, on 23 March 2015 (the Republic of Korea FTA), which is sometimes also called the KNZFTA.

The rules of origin and the product specific rules in the Republic of Korea FTA are incorporated into the principal regulations by reference, and with specified variations to Tariff item references. At the time of the making of these regulations, the text of the Republic of Korea FTA is available at https://korea.fta.govt.nz/agreement.php. The variations are specified in new Schedule 9 (inserted by regulation 5 and the Schedule). They reflect updating maintenance of the product specific rules. Future similar updating is contemplated after the entry into force, and under Article 4.14.3(b), of the Republic of Korea FTA. The abbreviations (for example, “WO”) in the third column (Proposed rule following transposition to HS 2012) of new Schedule 9 are defined in paragraph 6 of the Headnote to Annex 3-A of the Republic of Korea FTA.

Access to the provisions incorporated by reference is also facilitated by the chief executive of the New Zealand Customs Service in the other ways required by section 287D of the Customs and Excise Act 1996.
