Companies Act 1993 Liquidation Amendment Regulations 2016

These regulations are made under section 277 of the Companies Act 1993 on the advice and with the consent of the Executive Council.

Regulations

1 Title

These regulations are the Companies Act 1993 Liquidation Amendment Regulations 2016.

2 Commencement

These regulations come into force on 24 March 2016.

3 Principal regulations

These regulations amend the Companies Act 1993 Liquidation Regulations 1994 (the principal regulations).

4 Regulation 28 amended (Remuneration of certain liquidators)

In regulation 28(1)(b)(i) and (ii), replace “$200” with “$230”.

In regulation 28(1)(b)(iii), replace “$140” with “$160”.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 24 March 2016, amend the Companies Act 1993 Liquidation Regulations 1994 so as to increase from $200 to $230 the hourly fee prescribed for the purposes of section 276(2) of the Companies Act 1993 for liquidators and for accountants and solicitors employed by liquidators. The hourly fee prescribed for those purposes for other employees of liquidators is increased from $140 to $160.
