1 Title

This order is the Social Security (Rates of Benefits and Allowances) Order 2016.

2 Commencement

This order comes into force on 1 April 2016.

Order: confirmed, on 17 December 2016, by section 16 of the Subordinate Legislation Confirmation Act 2016 (2016 No 103).

3 Schedule 1 of New Zealand Superannuation and Retirement Income Act 2001 amended

(1)

This clause amends Schedule 1 of the New Zealand Superannuation and Retirement Income Act 2001.

In clause 1(a), replace “$431.10” with “$443.43”.

(3)

In clause 1(b), replace “$396.17” with “$407.53”.

(4)

In clause 1(c), replace “$326.30” with “$335.74”.

(5)

In clause 2(a), replace “$652.60” with “$671.48”.

In clause 2(b), replace “$618.08” with “$636.20”.

4 Schedule 31 of Social Security Act 1964 amended

This clause amends Schedule 31 of the Social Security Act 1964.

The amendments made by this clause take effect from the close of 31 March 2016.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 1 April 2016, increases—

  • New Zealand superannuation entitlements to implement the Government’s commitment to ensure that the net married couple rate of New Zealand superannuation is set at a minimum of 66% of the net average wage:

  • disability allowance income thresholds to ensure that current recipients of New Zealand superannuation or the veteran’s pension do not lose eligibility for a disability allowance as a result of the increase to the rates of those benefits under this order and the Veterans’ Support Amendment Regulations (No 2) 2016.

This order is a confirmable instrument, and an annual confirmable instrument, under section 47B of the Legislation Act 2012. It is revoked, or taken to have been invalid for past operation, at the close of 30 June 2017, unless earlier confirmed by an Act of Parliament. That stated time is the applicable deadline under section 47C(1)(a) of the Legislation Act 2012.
