These regulations are made under section 65 of the Chartered Professional Engineers of New Zealand Act 2002 on the advice and with the consent of the Executive Council and on the recommendation of the Minister for Building and Housing given after consultation with the Chartered Professional Engineers Council.

Regulations

1 Title

These regulations are the Chartered Professional Engineers of New Zealand Levy Regulations 2016.

2 Commencement

These regulations come into force on 1 April 2016.

3 Levy

(1)

The Registration Authority must pay to the Council—

(a)

a levy of $25,000 for the period beginning on 1 April 2016 and ending on the close of 30 June 2016:

(b)

a levy of $100,000 for the financial year beginning on 1 July 2016 and for each subsequent financial year (the annual levy).

(2)

The levy of $25,000 is in addition to the levy of $70,000 already paid by the Registration Authority to the Council for the financial year beginning on 1 July 2015 and ending on the close of 30 June 2016.

4 When levy must be paid

The Registration Authority must pay—

(a)

the levy of $25,000 on 1 April 2016:

(b)

the annual levy on or before 14 July each year.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 April 2016, replace the Chartered Professional Engineers of New Zealand Levy Regulations 2004, which are revoked. Those regulations provided for an annual levy fee of $70,000 to be paid by the Registration Authority (The Institution of Professional Engineers New Zealand Incorporated) to the Chartered Professional Engineers Council. These regulations increase the annual levy payable to $100,000. The regulations also prescribe an increase of $25,000 in the levy payable for the period 1 July 2015 to 30 June 2016 to address a shortfall in funding to enable the Chartered Professional Engineers Council to carry out its statutory functions for that period.
